Dear Governor Abbott:

 

First, let me tell you that I have been a licensed Texas Real Estate Broker for fifty-one years, and that has been my profession throughout those years.

 

I believe that SB 2212 was ill-conceived, and I am disappointed that it has been signed into law.

 

The public is becoming more and more confused as to who has the state’s authority to broker real estate. 

 

We have a regulation that apparently allows persons with salespersons licenses to use their names in DBAs that appear to the public to indicate that they are brokers.

 

We have franchise offices that are owned by one group.  In many cases the owner isn’t a licensed broker, is, in effect, operating the offices, and there is no licensed broker on the premises in each of those offices who is responsible for the salespersons whose licenses hang in the office.

 

We have web sites like Truila, as an example, that have no state license but, in effect, are operating for all practical purposes as a brokerage office.

 

SB 2212 only helps those who shouldn’t be.

 

Please rescind it.
