I have signed it and in Florida I am not an attorney, I cant give an opinon on law. I can ask questions though like everyone how does Zillow get away with this?
This is my opinion:
The company must be registered with the DBPR/DRE as a real estate brokerage since collecting compensation in connection with the referral of real estate business and they played on the line of ethics and I feel falls within the definition of real estate activity pursuant to Section 475.01(1)(a), Florida Statutes.
Everyone played along since they were paid subscription services and advertising and promoting Realtors, now though being a public traded company they have to weigh the backlash of Realtors who fully fund the company currrently through ads the ceo admitted to Inman that better than 70% is from Realtors pockets.
They give nothing of value and have not brought a new market or tech that helps the progression of Realtors its a website with a leadrouter type function.
This is what the petion says
"The undersigned respectfully request that NAR:
1. Recognize Zillow’s Instant Offers as an intrusion into real estate brokerage by an unlicensed firm.
2. Recognize that Zillow’s Instant Offers damages homeowners who may unknowingly sell to sophisticated investors for less than full value and without advice from an attorney, Realtor or appraiser.
3. Recognize that Zillow’s Instant Offers demeans the role of a Realtor by encouraging home sellers to deal directly with buyers.
4. Demand that Zillow discontinue Instant Offers or risk losing Realtor listings and advertising.
Submitted by concerned homeowners, appraisers, attorneys and Realtors.
