Oh golly gee whiz....that mortgage that has both husband and wife owning the property....don't worry about it ? The one that says you are equally liable for every nickel owed ...THAT piece of the marriage/divorce puzzle ?
Please DO worry about it...worry about how your name gets OFF the mortgage or IF your ex is"buying you out" that ever piece of paper provided as proof of intent to purchase is examined for accuracy. The problem is that Lawyers don't always know what IS accurate....and instead of advising their clients to have someone else review it....they give their stamp of approval on anything that "looks official".
That is one of the reasons we find ourselves seated in courtrooms or emailed legal documents when we are appointed the agents for the house that was never sold as was ordered in the original divorce decree....could not be refinanced...which was obvious BEFORE the divorce was granted....but the ever so famous "Re-finance or Sell" issue was ordered years before....that is the way it has been and for the immediate future...is now....urgh.
If your name is on ANYTHING...the mortgage, a credit card, a medical bill, a bank account....and you are in the process of or have divorced and you are not in sole and complete control...DO worry about it !
Remember the person that you did not trust as a marital partner now may have that control ....and may not pay bills on time, completely...at all....and continues to destroy your credit.....and theirs as well....while they continue down the path of financial destruction.
If you are unclear what your financial responsibility is...if you can't understand the documentation...if none or only part of it was provided....Do more than worry...consult the highest and best source you know to clarify the situation and see that you do whatever it takes to become a WHOLE person on your own without someone else pulling your financial strings or breaking them....be your own independent person...with Financial liberty and justice for YOU !
