An Inspection Gone Awry

It was supposed to be a simple inspection. I’ve been a Realtor for decades and am conscientious with people's property. I coordinated all of the necessary inspections on a four-plex for a three-hour window today so we only had to disturb the tenants once.

One of the tenants is a semi-hoarder and there were papers and trash everywhere. The bedroom floor was covered in clothes, blankets, stuffed animals, and shoes. The Inspector wanted to inspect the crawl space and the only access was through the closet floor in this man’s apartment.

The sewer scope company could only access the line through the closet entry because there wasn’t an outside clean out and I didn’t want them to remove the toilet.  I looked at the closet piled with shoes and tried to figure out an alternative, but unfortunately there wasn’t one. I should have taken a picture right then.

Before long, the bedroom floor was covered with more shoes, the roto-rooter company had their video, and the inspector had finished what he needed. When it came time to close up shop, I asked them both if either of them knew which shoes went back in the closet and which had been on the floor. Claiming ignorance, they put them back as close as what they could remember and left it in better shape than it had been when we got there. 

I received an irate call this afternoon from the tenant about the absolute destruction we caused in his apartment, and he wanted me to come over and arrange his shoes in neat rows the way they had been before (trust me, they weren't). After a fifteen-minute tirade, I told him I would bring my husband and come and arrange his shoes, but I probably couldn’t do a good enough job to satisfy him. As an alternative I offered to provide him a $25 gift certificate to the restaurant or store of his choice, or even cash.

He called the Seller (I represent the Buyer), and the Listing Agent (a good friend who knows me well), and told them both that I was being totally unresponsive and wouldn’t do anything for him! I called him and said I would be over with my husband in half an hour to rearrange his shoes, and he said it has to be tomorrow.

He sent me this note: I have an idea: Rather than inconvenience you and your husband, how about for a $50 USA gift card we call it even? Please advise and thank you.

Smells like blackmail to me. I think my initial offer for a 15 minute job for $25 is fair (that's $100 an hour). When I didn't immediately respond, he sent me another text that said he would report me to DORA, our local board of Realtors, and the police if I didn't send him the $50 gift certificate tomorrow. (Yeah, call the police and tell them someone who was authorizied to be in your apartment rearranged your shoes. I'm sure they'll rush right over.) What would YOU do? (Besides take a picture of the closet before any shoes had been taken out? J ) PS - I ended up sending him the gift cert, even though it rankled me to do so. As our lawyer always said, Just write the check. It's so much cheaper in the end.

Wow, Mimi Foster. Sure can't make this stuff up!

To me, if an appointment had been made for these tasks, it is on HIM to provide proper access. I'd likely send the $25 gift card you suggested thanking him for his understanding (Especially since you know the owner & LA -and I'm sure they 'know' him).

Who wants to play around in his closet anyway!

I'm not sure I would have even offered the gift card OR to come over and arrange his shoes.  I probably would have snapped a pic of the closet before and used it as a reference for putting it back together, and snapped another.  No way an issue this inconsequential should be held over your head.

One of the bad things about people who are unhinged is that they become more unhinged if they are slighted, Chris Ann Cleland. He wrote the seller and the listing agent and told them that he was filing a police report, a report with the local board, and a dept. of real estate claim if I didn't take care of it immediately. I hadn't decided what I was going to do or if I was just going to ignore him, and this morning he started blowing up my phone with threats. Of course I kept them, but the listing agent said he was going to pay the guy if I didn't. The lawyer that used to teach our classes used to say all the time, "Just write the check. It will be so much cheaper in the end." As much as I hated to do it, I sent him a gift cert a little while ago. Lesson learned: never touch anything that belongs to a hoarder

OMG..what an ridiculous tenant! Its always hard to sell a property with a tenant in the home because so many ridiculous situations come up just like this one! I'd have done what you did..write the check and be done with it! Not worth the aggravation!

Thank you for sharing this story! I'm not sure what I would have done in the same situation, but now I know to make sure there is a picture ahead of time! Maybe I would call the owner also to get HIS permission to move stuff around. Geez. What a nightmare.

Yikes, Mimi, what a mess that turned out to be.  I would have sent the gift certificate, too, and hopefully washed my hands of the problem tenant. A lesson for the future I guess!

WOW! Sounds like he needs to get a life, Mimi! Holy MOLY! You did what you absolutely had to do. Sadly, he had you over a barrel and successfully blackmailed you. I'm so sorry! 

I don't know that I would think to have shot a photo of the hoarder's messy shoes or not but, you've taught me a lesson to do so in the future.

He was asked to clear them out before we got there because it was the only access to the crawl space, so I didn't have a lot of guilt rearranging them  But they were neater going in than they were before. Thank you, sweet Mimi! I'm sure they were neater - and honestly, with a hoarder, I don't believe it's possible to arrange things back exactly as they had them either. My father-in-law was one and his hoarding was of newspapers. If any of the children touched one paper in one stack, he would know it - it was insane!

I also think there is a missing screw with them - which also explains the bizarre response to you.

I have had hoarding houses more than once.  One time, in front of the tenant, who refused to leave, I left my shoes at the door (the house was filthy and the floor was not visible for all the mess).  She thanked me for showing respect for her house!

I'm going to video and photo shoot in a similar situation from now on.

I think I'd have called the listing agent and asked them what the seller and he/she wanted me to do immediately to get ahead of the lies of the tenant. But, you handled it well. We are constantly paying for other people's character flaws in this industry.

In "The Rest of the Story" department, things didn't turn out so well for the tenant. I got an email from the Seller saying that I had restored his faith in mankind, that the tenant had been a bully from the time he moved in, that he thought I handled the whole situation perfectly, and to thank me for not blowing up the deal over a crazy tenant . . . and after closing, my daughter became this guy's property manager . . . whoops.

And I would have called the agent (my friend) also, but tenant hung up from me and picked up the phone and called him and I never had a chance.

I hate it when blackmailers get their way.  From an efficiency standpoint you did the prudent thing.  That would have made a great Judge Judy show, though.
