Fiduciary Relationships in Real Estate Selling Agents & Buyers Agents

By
Real Estate Agent with HomeStarr Realty RS143922A

under contract

Great news as a listing agent a cooperating agent and I closed a transaction  . Her paperwork was a little sloppy but the terms were wonderful and so was the price  for my seller .  There were some documents missing . When I called her and asked for the paperwork she had the buyer call me directly

My seller being the very sharp lady she is was on Google. She knew so much about the buyer even what church he went too . The buyer promised to email me the missing documents he was in the car on the way home from work . I would have them within the hour or two depending on traffic as it was rush hour . My sellers could hear the buyer  and were good with his answer . He would call me when he got home and then scan and email them directly to me .  The sellers signed his agreement  and I told them I would text them when I had the missing documents .

The buyer was good to his word and a few hours later called me at home with all the signed paperwork . I congratulated him as in Pennsylvania it is offer and acceptance . He was so excited . He explained to me how many properties he had lost . This one he did not want to lose as it was just what he wanted . We talked for a little longer I wished him the best of luck and he could not thank me enough . I called his agent and left her a message .  His agent did not return my call  just a text few hours later  where we stand ?

Shocked just a little that she had not communicated with her buyer I explained we had a signed contract as I explained in my voice mail .There still was some missing information but not on my side on hers .Now I am getting text messages to give the buyers  mortgage company missing information . I was at a closing I told her I was at a closing call the office the girls will give her the information for the mortgage company .

Well now  text messages are getting nasty . Giving me instructions and the email of the buyers mortgage company and telling me to supply the information that she can look up on the Multiple Listing Service or call my office and get from my wonderful support staff

Normally would do it in a jiffy but this agent is getting paid to do a job for the buyers .  I work for the sellers .  I feel like I am doing both sides of the transaction . This is simple information . I am not her assistant  . Look it up in the Trend Multiple Listing Service  or call the office . Do not be abusive that is the totally wrong approach to take with me . It is not my responsibility to call your  buyers mortgage company  with simple information  that you can do yourself .

Now if there is a problem we need to work out I am right there on the phone doing whatever needs to be done  to find a solution to our dilemma.

Sellers agents and buyers agents we each have a job to do lets to it and get the job done  and the property to the settlement table

Hey sista,
I had a few transactions like that but I never put up with any sh*t from the other agent.  I wonder if her broker has any clue how unprofessional she is?  Good job!

Ah yes, this is the exception, rather than the rule, but we are familiar  with it. Generally, the agent sighs and tells us how busy she is with all of her transactions and can we please just handle it for her. We find it to be big pain, but comply to keep things moving. And, make a note not to work with the agent ever again - if we can help it.

Well that's an entirely different animal - I too would have responded with a firm "you need to do your own job."

Hannah, FYI it happens in this part of the world too, needless to say my take is anger, frustration then at the end we need to make it work with or without the buyer's agents, help, Endre

Endre Barath, Jr.  She will do what she has to do . This was simple information  her mortgage company requested that could be found in the MLS system . I am sure I would have heard from the mortgage banker if it was not received . I will follow up later this week  not with her .

Thank you for your valuable input always appreciated

It is sometimes easier to take charge of the transaction rather than trying to train the other agent.

Roy Kelley  I agree if it was something that would prevent the transaction from moving forward it would be done . This is not the situation .

Gabe Sanders  Yes it can . I do not mind taking control but abusive behavior is not acceptable . Then the agent must be put in their place .

Thank you both for your professional opinions

Hannah,   I am amaze at some agents, I had one new agent that was not a R and did not the point in being a R ad said I found that protery for them now you do the rest, you need to sell it for for your buyer.  I had a long talk with his broker and his broker said he been doing that for year.  No they do not even go to closings.

Unfortunately Hannah this agent doesn't surprise me as we have been dealing with a similar situation. Ours has been in the business a long time, and I think maybe it's time for her to leave the business!

Funny this woman has also been Lawrence "Larry" & Sheila Agranoff. Cell: 631-805-4400  for many years . I just think she is used to bulling  agents to do her work and most comply . I do not mind helping but there are times you need to draw a line a put them in their place .  You know what ?? She ended up doing what she needed to do .

Thank you for sharing your  professional experience as  your input is always appreciated

completely nuts what some agents expect.  Poor buyer without the kind of help they really need.

Hannah, Sorry to hear you are dealing with an agent that is outright lazy.  Such agents do a disservice to us all.  As you pointed out responsible agents are forced to do the job of another agent in order to ensure a deal continues.

Tammy Lankford,  Yes and get paid to do a job they do not perform

Gloria Todor  Happens less often thankfully ... but is annoying when they are nasty about it .

Thank you both for taking the time for your valuable input

Hope this all works out and gets smoothly to settlement. Sounds like the agent on the other side does not understand cooperation, and their own responsibilities to their client. Paperwork and how it looks is always a good indication what sort of agent you are dealing with.
