Then the individual's assets and affairs are processed through a court system called probate. In this process, often times there is real estate that the heirs will want to liquidate, not just because they want the money, although this does happen, quite often the heirs need the money to settle the estate, pay off creditors and other service fees.
It's A TON of stressful responsibility on an individual nominated by either the deceased ahead of time in a WILL or by the court called the Personal Representative.
This person, if the deceased did, in fact, have a WILL in place this "PR" would then petition the court for EXECUTORSHIP.
NO WILL the PR is an ADMINISTRATOR of the estate.
Now, what's MOST IMPORTANT is the next course of action of the PR.
During a court scheduled proceeding the PR goes before a judge and petitions for two things.
1) Executorship or Administrator
2) Full Authority
