Questionable Real Estate License Exam Question #1

So my wife, Laura, is going through her online real estate licensing course and she has had quite a few issues with the wording of some of her quiz and test questions. I thought I would share some of them with the ActiveRain community and see what your thoughts are.

This particular question just seems to be poorly written and a bit confusing:

 

A listing agreement is a legal

  1. contract between the seller or buyer and a broker that establishes their agency relationship.
  2. sales contract.
  3. assignment agreement.
  4. document that states the terms of the mortgage.

 

Let me know your thoughts. Do you have any issue with the available answers?

#1. is the obvious answer.  Kevin Ray 2) A listing Agreement is never a sales contract. 3) it's not applicable that a Listing Agreement gets assigned.

4) A listing is not a mortgage. Teachers like to word a question so that it may appear tricky.

My question though is why would they mention the buyer in the answer. That makes the answer incorrect to some degree. I agree that 1 is the answer, but by stating that a listing agreement is a contract between buyer and broker..... that is not correct. It is just a poorly written answer is what I am saying.

Kevin - referring to you answer to Bruce Hicks , that was my first thought as well. The listing agreement doesn't mention buyers.

I honestly wouldn't know how to answer that - but you're also in Colorado so there are always difference in the way terms are used.

Thanks for commenting on this. There have been a lot of odd questions in Laura's course and I will be sharing a few of them here to get everybody's thoughts on them. This one is not nearly the worst, but it makes you stop and wonder if you are missing something; I think the answer should have left the buyer out of it because there is no reason to mention the buyer.
