. We were referred to a soon to be divorced couple as listing agents. One of the "extra" benefits you get as an agent in divorce is one transaction can mean two or each former spouse makes a purchase or you divorcing houserefer them to another agent out of the area...such great Sellabrations !
       Then assumptions by some divorcing that everything is divided 50/50...the expenses in getting the house ready as well as the profit from the sale in a state where the house is considered community property and that scenario fits the situation. Not divorce like most of life...always and never don't apply. Assets can be split in a variety of ways as can the liabilites with many factors considered including but not limited a disparity in income of each spouse and other factors which influence the "division".

     Sometimes we are not the first agents....agents beforhouse in divorcee us...never get the house listed...list it at a priee that the market won't minimize conflict...they ignore the whole ''pre-marketing" and getting the hiouse ready to sell step in listing the property. Tbis also of course, does not maximize the return for both soon to be ex spouses on the sale of what can be one of their largest assets.

     The agent before we were contacted had worked with the divorcing couple for seven months and did not get the house liseted or the items that needed attention in the house, addressed. There were lots of legal bills incurred by both parties and no resolution to the issues or achieving the goal of the "highest and best" sale price of the house.

       Divorce, we believe is a specialized area of that we have been trained in and practiced for over a decade. If you are divorcing, having an agent with education in divorce is important. This background can ldivorce ringsessen legal bills and lower the stress level of the entire transaction when emotions run high and there is considerable money at stake in resolutions to conflicts during the listing.

   We often hear from other agents "I have been divorced I know how to handle a divorce in real estate."  Our answer to that is that you bring your experience...which is different than bringing education. We are happy to answer any questions any advice is not what we offer...that is the lawyers' province in these situations. We do work hard to address the situations unique to this kind of transaction.

I always tell my divorcing couples to NOT clean out the master bedroom closet. I've seen too many times where the guy leaves the house and takes all of his items out of the master bedroom closet. The wife never thinks to spead out her stuff in to the vacated area! In our MLS there is no reason given for the sale unless specificially approved by the Sellers. I'm always looking for an edge for a buyer and watching the back of my Sellers. If you selling the home to settle the divorce I reccomend they BOTH get out.

 In hundreds of divorces the training we got and we give we have never suggested both people vacate the needs to be maintained ,,,grass cut, snow shoveled,,,shows better with furniture.  Not likely both can or should pay rent and a mortgage besides Mike Kelly,CRS,CIPS ...these are troubled times and the extra financial burden would be one more troubling issue.

Great post and advice.  I can attest to been there, done that.  There are so many facets to selling a house during a divorce and counseling is definitely a big part of it as an agent.
