Bad Deeds

 

Now that blog post  title sounds like something that might be part of a bad joke where every bad deed that you ever did is some how stored in a file somewhere for the after life.

 

BUT the title is referring to deeds for land. Bad Deeds... Deeds that can't really convey a tract of land because the legal description does not enclose a tract of land. AND in a way, they are stored for the afterlife.. life after the deed is filed because now you have a title issue that will haunt someone at some point and have to be fixed to have good and marketable title. 

 

There are all kinds of issues that come up with deeds that might cause them to be called a "bad" deed. 

 

One of the issues that can cause a deed to be a bad deed is if the legal description does not close. Legal Descriptions have to "close in" a piece of land so it is complete. If they do not close in the land, then the sq ft or acres of the land is undefined.

 

Lots and Blocks as legal descriptions close because they are described and shown on the filed plat at the court house.

 

Where more of the problems come from for non-closing legals are from metes and bounds descriptions.  Starting at POB, "Point of Beginning",  then the directions and length of boundaries, and then bringing us back to the POB. You see, there is no "Point of Ending"...only a Point of Beginning to begin and to come back to...  the point of ending is back at the point of beginning. 

 

If you've looked in a plat book or looked online and some land that you own does not have your name on it, it may be that the legal description on the land does not close.  

 

It is always best to have an attorney prepare your deed.  It is always best to have a survey done on metes and bounds.  "Always Best" does not "Always Happen" though.  

 

There are other ways that deeds can have problems but a non-closing legal description is one of the common ones.
