Dealing With Buyer Agent Mistakes After Closing Escrow

By
Real Estate Agent with Lyon Real Estate BRE #00697006

The relationship a buyer's agent maintains with a listing agent throughout an escrow tends to set the pace for future interaction. I'm not saying listing agents all have long memories, nope, that's what the Bad Agent File is for, heh, heh. In my business, I deal with way too many agents to recall the specifics of each.

It can be even a bit weirder if an agent has been openly hostile or arrogant. Makes it sorta hard for that agent to later beg for help. But it happens. I've watched the transformation happen before my very eyes. You can read more in my personal blog today at this link: MLS Says Refrigerator Stays But Agent Missed Offer Inclusion.

Hi Elizabeth Weintraub Sacramento Real Estate Agent, Top 1% of Lyon Agents, in May 2018, representing the buyers, I wrote Refrigerator, Washer, Dryer in the contract even though MLS didn't show them conveying with the sale. The listing agent never noticed it, we discovered during our walk through the day before closing all the appliances were taken by the seller. The listing agent argued that she never put them in MLS and my argument was the executed contract by all parties. Those appliances were back at the house the day of the closing.

Pat Champion There is simply no reason to be antagonistic during a real estate transaction. I am constantly astonished at how many people turn into ogres when they don't get their way. Like the world revolves around them.

I watched a bicyclist today in traffic decide to cross 15th Street, a busy one-way street, in the middle of the block. He stuck out his arm and manuevered between cars to get to the other side, like everybody in a vehicle should stop in the middle of the street to let him pass because he had an urge to suddenly cross the road.

Beth Atalay Good for you. And that listing agent shoulda known better, but so many, unfortunately, do not. They don't like these "stickler" details in a contract.

Our contracts are very specific about what has to remain with a home... that being said fridges, washers, dryers, curtains/drapes are all personal property. If your buyer wants it you'd better make sure it's been written into the section in the contract that itemizes personal property to convey at no monetary value. I'm so anal about it, I further describe that property as "fridge in kitchen at time of showing on xyz date." I've heard of sellers moving a trashy fridge from the garage into the kitchen prior to closing because which fridge stayed had not been specifically identified.

Nina Hollander I am constantly amazed at the lengths some people will go to justify the end result, especially when they know it is wrong. It's like, "we can't be doing anything wrong if we can come up with an argument and line of reasoning." But they know they shouldn't have done it.
