What is a Probate Sale in California?
A probate sale of real property in California means the person who owns the home has died and the estate representative is selling a home as part of the probate process.
Most probate sales are not complicated and do not require the court's approval to sell.
When the executor or administrator is granted full authority under IAEA, the court's approval of the sale is not required. We are required to follow the probate process which means the estate attorney mails a notice of proposed action to all parties who are entitled to receive it.
Unless the parties sign a waiver of notice, we are required by law to allow15 days post mailing of the notice before we can close escrow.
In most cases, we can close escrow in 30 days or less.
This home is being sold with full authority to sell under IAEA.
There is no reason to be intimidated purchasing probate real estate. Just be sure the agent you are working with understands the probate process and knows how to manage the details.
