FHA Update. ML 2019-06
As of April 18, 2019 FHA has made SIGNIFICANT changes to guidelines for ANY type of down payment assistance programs (DPA) Including all "government entities"
this effectively eliminates the Cheona Fund effective immediately.
- All other Government Entity Down Payment Assistance programs:
- For case numbers issued on and after April 18, 2019, any funds for the borrower’s minimum requirement investment (MRI) that come from any government entity, in any form, is subject to the requirements of this ML.
- The ML places significant legal requirements on the various government entity to proof their ability to meet FHA requirements.
- It appears, FHA did not provide prior notice to any government agency regarding this change. Consequently most agencies are currently not prepared to provide the proper documentation needed in order to continue with the program.
- Some government agencies have already suspended taking reservations as it plans. As one example, we have already received notification from the State of Alabama suspending the program and we certainly expect many others will follow.
While we will still accept applications that include Government DPA programs moving forward- any approval will be subject to the program meeting FHA Guidelines prior to closing. Effectively- these programs have the potential to cause delays.
Keep in mind that this Mortgagee letter is for loans with case numbers from 4/18/19 moving forward. Loans that received a case number 4/17/19 or earlier will fit into the old guidelines.
