TX Homes Improvements/Accessories - What Does It Mean

When purchasing a residential property in TX, Buyers want to know what is included in the Sales Price. As written in the One-to-Four Family Residential Contract (Resale) everything attached including improvements and accessories are part of the purchase with the property.  The definition of Improvements and Accessories are as follows:



  • The house
  • Garage
  • Attached Fixtures & Improvements, i.e., light fixtures, ceiling fans, faucets, plumbing 
  • Any and all appliances
  • Valances
  • Window Screens
  • Shutters
  • Awnings including remotes
  • Wall-to-Wall Flooring (not including throw rugs)
  • Mirrors attached to the wall
  • Heating 
  • Air Conditioning
  • Attic Fans, Heating Ducts, Air Vents
  • Chandeliers
  • Mounts & Brackets for Televisions & Speakers, Antennas
  • Security & Fire Detection Equipment
  • Water Softener System
  • Tankless or Regular Water Heaters
  • Mail Boxes
  • Kitchen Equipment (i.e., Stove, Microwave, Dishwasher, Garbage Disposal)
  • Garage Door Openers
  • Landscaping (i.e., fence, trees, plants, shrubbery, mulch)
  • Outdoor Cooking Equipment
  • Electrical Wiring
  • Plumbing
  • Fireplace Mantle
  • Anything else permanently attached



  • Refrigerators
  • Window Air Conditioning Units
  • Fireplace Screens
  • Curtain Rods,
  • Blinds,
  • Window Shades
  • Draperies & Rods
  • Door Keys
  • Electronic Remotes Controlling Permanently Attached Items
  • Above Ground Pool
  • Swimming Pool Equipment & Maintenance Accessories
  • Artificial Fireplace Logs
  • Controls for Garage, Entry Gates
  • Any other Accessories for Permanently Attached Real Property


Exclusions: Sellers who prefer to keep something on the above list should remove it and replace it with a like kind before they list or put that item into the exclusion. In TX refrigerators, washers and dryers are considered personal property and do not stay with the house unless it is offered and negotiated as personal property.

This is interesting that everything is presumed to stay unless excluded. It looks like it's up to the seller to exclude any items that do not stay.

In Maryland, we specify what stays and what's excluded. Good list for your area.

Interesting Patricia. Here are Long Island, it would be very unusual not to include the refrigerator, washer and dryer!

That is a great list, within our contract these items are spelled out for the seller to initial.  I walk through the home with my sellers and point out things and tell them if they want to keep it, they should take it down and put it out of sight before listing.

Buyers and sellers should look at your list to understand more of what they need to be aware of.
