i) Can I repay my Alipore home loan from the money I received from the Maniktala house sale?
You may utilize the funds received from the sale of property in any judicious way. However, to get the benefit of the exclusion under capital gains as per Income Tax Act, you need to attain the conditions as declared in the act. Hence, reimbursing the housing loan for another home is not eligible for exclusion u/s.54.
ii) Can I invest the capital gain amount to buy a land/shop to save 20 per cent tax?
The mere purchase of residential plot is not enough compliance of provisions of section 54. What is expected from the person is to prove on record that the person had purchased or build a house within the period stated in Section 54 on that residential plot.
iii) Can I invest with my brother-in-law to save capital gain tax? He recently sold one property in Himachal Pradesh and I can contribute Rs 17lakh.
The law does not clearly say that the new property must be purchased only in the name of the seller and not on anybody else’s name. Hence, there are explanations that joint ownership can be allowable, but exclusion can be limited to the share of ownership.
