NC Real Estate Q&A - Neighborhood Demographics

 

Q: Why won’t my agent discuss neighborhood demographic information with me? 

 

A: The federal Fair Housing Act and North Carolina’s State Fair Housing Act both prohibit discrimination against any individual based on race, color, religion, sex, national origin, handicap or familial status in the sale, rental or advertising of any and all residential property. As well, a violation of federal and state fair housing laws by a real estate agent is also a violation of our Real Estate License Law. 

Code of Ethics and beyond

In our state, we are bound to be mindful in, not only advertising but, verbal comments, with reference to race, religion, national origin or any of the protected classes. Spoken or written words in violation of fair housing are equally offensive and the punishment, equally as harsh. 

 

Realtors® are bound by the REALTOR® Code of Ethics, which contains Article 10, prohibiting Realtors® from discriminating on the basis of race, color, religion, sex, handicap, familial status national origin, sexual orientation, or gender identity. 

 

Standard of Practice 10-1 states: “When involved in the sale or lease of a residence, REALTORS® shall not volunteer information regarding the racial, religious or ethnic composition of any neighborhood.” 

 

Bottom Line

 

In the world of residential real estate in North Carolina (and South Carolina as well), we are bound NOT to provide neighborhood demographic information. 

I have, and always will, continue to advise my clients that because of fair housing laws, I are not permitted to provide information regarding any of the protected classes, but they are certainly free to obtain it from a multitude of other sources available locally and online.
