Two different scenarios I want feedback on!

First Scenario

Does the seller's agent have a right to see the credit report of the buyer...and since I have seen on MLS that this has been required what is the seller doing with the credit report? 

If the buyer refuses to hand over his credit report to the seller side and is told by the agent representing the seller that you will NOT get the home can the buyer sue the real estate agen?

Would a buyer's attorney advise a buyer to hand over the credit report to the seller?  What do the rules dictating the licensing and ethics of a real estate agent say on this matter?

This is not a REAL scenario so please odn't make that assumption(ie it is NOT something I am going thru ) ....

and I don't mind opinions....but I prefer factual responses based on actual laws or rules.

I am not looking for legal advice on this ..I am curious about what the truth is behind this....

btw if you read my last blog I have been told that it is squirrels or rabbits....I feel like that guy..Elemr or Elmo Fudd?  what was his name?  "Come on out ya little wabbit!"

 SECOND SCENARIO

I CONTACTED A DIVISION OF A COMPANY THAT WOULD ALLOW ME TO SELL TEM INSURANCE.  gOT A MESSAGE FROM the Business Manager  THAT LEFT ME AN overly energetic message ...like he had a few red bulls to many.....was real busy to call him back that day....and customers take first priority over vendors..second day received another voicemail....was out in the field all day...next day I received an email....

"

Have attempted to contact you by phone and email.

The ball is in your court.

If I don't hear from you by Monday I will delete you from my list."

Now this email was sent to me Friday and the first and second voicemail was sent to me wednesday and thursday.....

What alarmed me was that all of a sudden he is going to delete me from his list???? The ball is in my court but why does the game have to end so suddenly?  What if I was away?  In the middle of a family crisis? Away on a business trip?  where does this two day rule come in?  

I sent him a polite email telling him I am not interested anymore due to increased obligations towards my customers.  I felt turned off that he turned so bitter when we haven't even started working together yet!  All of a sudden he is threatening to remove me from his list?????  So much for networking!!!!

I am going to call headquarters and request to work iwth another rep that understands that being to agressive with a potential source of business(me) doesn't work well with me.   

What do you think???   Do you feel like people MUST call you back when you want?  If someone doesn't call you back on a not urgent business matter liek this do you tell them you are going to delete them from your list?  Of course I know I could have called him back earlier but like he said..I did feel like the ball was in my court..but I didn't feel like deleting HIM from my list!????

Vincent-great points! I personally wouldn't hand over the credit report to the seller...seems privacy rights might be an issue here ...its just a hypothetical but also seems like your the only one brave enough to answer....I know about 10 others read this blog--they know who they are!

On the second one...LOL!!! That's how I felt...like he was unprofessional and if he is getting irratible now ho wwill he be when we start doing business and a problem occurs...???

More importantly I luv your point "IF the company" is legit....this guy represents his company through his behvior!

First scenario, as a seller's  representative you have an obligation to guard his personal financial information. The Buyer and his/her agent may request a loan approval letter indicating that the buyer has been approved for a loan but asking to see a credit report is out of line.

Second scenario, send that poorly skilled salesmen an email back indicating that you are deleting him from YOUR LIST due to his lack of professionalism. He's done you a favor. You have found out very early what kind of businessperson he is. He sounds very desperate.

Lisa-great coming from an attorney-yes, as the buyer's rep in this fake scenario I would not as a loan officer hand over the credit report requested by the seller's real estate agent who claims they need to know that the buyer is qualified......in fact I would probably call the buyer's attorney and ask her/him to speak to the real estate agent and put a stop to it.

Re the pathetic salesman...he was actually the "senior" guy so I Love your point about deleting him from my list! Hah! and yep you are right about how its a good thing I found out early what kind of a loser he is..and he is a loser cause HE LOST MY Business!  And that's a FACT!
