You Can't Change Horses with a Home Inspection....

. In Wisconsin, and we suspect elsewhere...a home inspection is a common contingency in an offer to purchase. In Wisconsin, home inspectors are licensed. They may well be formerly in a trade and taking a different career path. Their reports can say....have this or that evaluated by a licensed....name that trade... What it should not say is ....it will cost $X to replace or repair whatever it is ...that is beyond the scope of their inspection.  

   A Buyer may not substitute Uncle Harry...every contractor on earth (to avoid paying for an inspection) to make their assessment and offer quotes. IF (and there are 99% of the time) things a home inspector points to in the report that require attention....the Buyer sends the Seller an amendment requesting the repairs/replacements.  The Buyer cannot go around the home inspector by inviting contractors and using that as an excuse to reduce the price OR ask for repairs. 

   The only horse a Buyer has to ride...and the Seller can choose to heed is the Home Inspector...when a Buyer after his recommendation can have situation further evaluated and replaced or repaired. There are no "end runs" in trying not to pay an inspector and getting price reductions or repairs done.  No points for creativity Ms/Mr Buyers agent....that's not the law in Wisconsin.

Inspectors need to be practical, especially when most of the homes they are evaluating have been used for many years.

Colorado area is not licensed yet but getting closer to making them.  I have seen one guy that had no experience and just printed up flyers and a cheap rate.

Hello Sally and David - a contingency of any kind is one thing but thanging horses is an entirely different matter.  Understanding the sales contract is important.  For buyers, sellers and practitioners alike.  I imagine it's valid for equestrians too should they be involved in the transaction.   Otherwise, hot so much.

This is a part of my job that I sincerely dislike. I tell clients all the time, this is not the time to renegotiate the contract, and yet inevitably that's exactly what they want to do. Good post!

Same thing in my area, thing is if the contract is terminated, then the seller must disclose all the issues the inspector found

We are negotiating two inspections right now - one for our sellers, one for our buyers. Interestingly both homes are about twenty years old, and both sides are singing the same story, "replacing a roof in 5 years just isn't on our agenda.  We may need some room in the price." Argh. Wish us luck.

Inspectors had just begun to come on the scene here back in 2005 when I let my license go. Unfortunately, the ones I ran into weren't so hot. One nearly got us in a lawsuit when he reported that the attic fan worked - and there was no attic fan.

Hopefully by now the local inspectors have had a bit more training.

Thanks for helping keep a balance on the home inspection process and the home inspector qualifications, which is all about the seller disclosure laws when selling a home, it is best to use an inspector that understand these requirements, when home inspectors state does not require a license it is good to hire a certified home inspector. The inspectors only job is to make sure the buyer is informed of the issues that need to be disclosed only after which the buyer can decide if they want to continue or not that is the end of the inspectors responsibility. I appreciate your post thank you.

Over the past few years I've seen a change regarding resolving inspections. If it's something simple like installing a radon mitigation system or installing a new roof (mandated by lender) -- that repair can be easy.  It's the laundry list of smaller nit picky items that don't cut it anymore. Lenders don't like to see it and sellers don't want to do it.  So we often see a credit--that way the buyer can contract who they want after closing.

Good advice here, Sally and David. Home inspections, and the potential repairs request can often create a lot of anxiety and perhaps even become contentious. Buyers and sellers obviously have vastly different perspectives!

Sally & David, Some home buyer will use the home inspection to get a price reduction. It is a preferred method to do an concession or price reduction vs. repairs. However, we have to get estimates. Buyers sometimes get an idea that the repair will cost quite a bit more than it does.

Inspectors in NC have to have a state license! No price quotes ever. I probably would refuse to represent a buyer that will not have an inspection
