There were six new laws implemented in California commencing on January, 1st,  2020. These laws will change the California landscape, literally and figuratively, for Single & Multi-Family existing and new homes for the foreseeable future. 

 

Like it or not, the time has come. Now for the first time, California property/homeowners can realize significant opportunities and profit from the very land they own beneath their feet. The 2020 California property/homeowner can now turn their single family residence into a triplex figuratively speaking.  

 

Starting with your primary residence you can now convert one the rooms within the existing footprint of your home into a Junior Accessory Dwelling Unit (JADU). All you need to do is provide an exterior entrance to that room, add or share a bath with a toilet and/or tub ad shower and install a modest kitchen/kitchenette (oven & cook-top, sink with hot & cold running water and a modest fridge) and you're in business.

 

Additionally, you can now even convert your attached or detached garage into an Accessory Dwelling Unit (ADU) or add a free standing ADU, be it a custom ground up 

design/build or one of many off-site i.e. HUD Manufactured, Modular, Kit (penalized) aka "Flat Pack"  solutions.  Several California jurisdictions have also introduced their own "Pre-Approved Plans" and permit free options.

 

Regardless of what, why or how you wish to progress down this road the path will now be open to you and flow much easier and in a much more affordable way. Lenders are finally wrapping their arms around this budding opportunity. Additionally, real estate developers and investors are salivating over the opportunity to realize even greater ROI than ever before on their real estate portfolios.

Very interesting! Permit free options sounds risky to me. What am I missing? Wouldn't that pose a risk for safety, i.e., electricty, heating and air, plumbing, and safety? How does this impact appraisal values and are there tax consequences for property tax? I'm pretty sure they would have to be insured too, correct?

Already is Kris Collis, Associate Broker However, a lot of jurisdictions have come out with their own pre approved plans and are waiving permit and entitlement fees which does tend to streamline the process. That stated, the jury's still out as the volume of permit apps increases. We'll see. But it's certainly not bad for real estate, contruction, property/homeowners looking to add revenu streams to their property and most importantly folks in need of housing.

San Diego County is allowing unpermitted, non conforming, illegal ADU's to come out of hiding and apply for "As Built" pemits and bring them into compiance.

Great Q. If property permitted, constructed, inspected and CO'd appraisers and lenders have to include the additional sf into the appraisel and the loan. Yes, they must be insured; especially if financing is involved. There are insurance carriers that will insure both under the same policy.

That's one of the primary motivations for a good percentage of property/homeowners Myrl Jeffcoat Most of my clients for the past 3 years are interested in either

  • Moving into it themselves and selling or renting their primary residence,.
  • Providing housing for a healthcare or homecare provider.
  • Providing housing for a child.
  • Providing housing for a parent. 

Maybe 1 out of four is doing if for providing an additional income stream. That's not to say that it won't go that way at some point but it's not the primary motivator.

You have a valid point Sandy Padula and Norm Padula, JD, GRI This pretty much sums it up. Bottom line? Doesn't look like there is one for this dilemma. Looks like double speak. Parking will be an issue. However, it's the lesser of two evils when you compare it to midrise work/live communities that are popping up like weeds everywhere. Just sayin..................

Is Replacement Parking Required When the Parking Area for the Primary Structure Is Used for an ADU?

Yes, but only if the local government requires off-street parking to be replaced in which case flexible arrangements such as tandem, including existing driveways and uncovered parking are allowed. Local governments have an opportunity to be flexible and promote ADUs that are being created on existing parking space and can consider not requiring replacement parking.
