If you Buy the house you have to keep the cats

Have you ever heard of a seller insisting something stays with the house whether the buyer wants it or not? I was knocked off my chair when a would be seller told me the cats come with the home. I did not see any cats as we toured the home, so I inquired what she meant.

 

It seems as though the seller as some "outdoor cats". There are also quite a few feral cats in the woods behind the home. The seller is moving in her with daughter so can not take any of them with her. She wants to make sure the cats are taken of. 

 

Is this legal? Could i make this statement in the MLS? Will any buyer agree to it? Will it scare most of the buyers away?

 

Listing and Selling this home would be easy without having to include cats in the sale. It is not that i am talking down about getting the cats, my job is to sell the home. That means making the house appeal to the most potential buyers, not limit them.

 

I knew that before starting to market this home, I needed to talk to the sellers family. For those that think selling real estate is easy, it is not. For those that think all we do is sell homes, it is not. Making sure my clients are well taken care of is one additional job. In this case, it is making sure the animals are taken care of and working through some emotions. 

 

The family was not aware of the shear problem. They were aware of a couple of cats, but never really paid attention. The daughters kids are allergic, so no cats were moving in with them.

 

I got the listing signed. The seller needs time to get the home cleaned out which gave me time to work on the cats. A while back i sold a home to a very nice lady who was a veterinarian. We had a great conversation and i knew she would have answers. She agreed that trying to include cats with the sale was not an answer. She would be willing to use local volunteers to get the cats, have them all checked and get them into homes of people who want to adopt them. There was a good dozen in the woods that i saw come out when the seller put out food.

 

IN SUMMARY, I had to let the family know my plan. They said I went above and beyond my real estate duties. We all sat with the mom and let her know. She was very happy the cats would go to good homes. I was not sure how she would take it. But it went really well.

 

IN THE END: Real Estate is more than just selling homes. We support our cleints. Please support your local agent like me.

Good morning, Scott... at the end of the day, a seller can put any conditions they want on the sale of their home as long as they don't break fair housing laws. Now, that doesn't mean a house will sell will those conditions. Being a cat lover, it wouldn't bother me most likely. You did a great job of finding a creative solution that would take care of the kitties.

Oh Scott, you did go above and beyond and did the right thing for the cats.  Thank you for caring enough to do that ... and in the process give the seller peace of mind knowing they will be taken care of.

We had similar but on a smaller scale years ago.  FSBO seller wanted to leave the barn cats on the mini-farm.  In this case, but the buyers didn't mind.

We didn't actually put it in the contract but we had a seller ask that the buyer let the cat stay, he was an outside cat and pretty popular in the neighborhood and the seller had actually agreed with the previous owner to do so this buyer did too, LOL
