Tax compliance is a critical step in resolving IRS Tax debt. In most cases, the IRS will not consider any collection alternatives proposal such as Offer -In- Compromise, Installment Agreement, Currently not Collectible Status, if the taxpayer or business is not in tax compliance. You also must maintain compliance after reaching a deal with the IRS. If you fail to maintain compliance, the IRS, can and will void the deal.
Tax Compliance simply means that the taxpayer or business:
- Has filed all required tax returns. i.e. Income tax return for the last 6 years
- Is making tax payments for the current year either through sufficient withholding from their paychecks OR submitting quarterly estimated tax payments if they're self-employed.
- Current on 941 quarterly payroll and 940 return for businesses.
Even if you can not pay the tax debt it is worthwhile to file the return on time and avoid the failure to file penalty (5% per month capped at 25%).
