Is the Post Closing Occupancy Agreement Right for YOU?

You found the perfect home, and you need possession right after closing.   BUT, the Seller has not found a home, and asking for a rentback for a month.  What do you do?   Is this the right situation for you?

First, the Post Closing Occupancy Agreement spells out to the both the buyer and seller, how long the Seller can remain in the property, who pays for the electric and gas, and water.   Also, this document has an area to require the Seller to keep insurance on the property after closing.  (After closing, there is no homeowner's insurance, so they will need renter's or contents policy.)   Buyer also has the right to ask for a daily rental fee (usually the amount of their daily mortgage, but if competing with other buyers, sometimes this is waived just to get their bid accepted.)

I have created this document for buyers, but have to have a conversation to be sure they understand the ramifications it could have.

A Buyer will do their walk-through before closing, and get a key at closing, but won't be able to take possession until the agreed-upon date.    Will the Seller leave the property in good condition?   TYPICALLY, if a home is in good condition, and well-maintained, the Sellers usually do.   If there is any question about how to leave the property, spell it out in this document.   The Buyer also has a right to retain a deposit and return after they are able to take possession.  

 

If at all possible, I always recommend to both buyers and sellers to give possession day of closing.   Sometimes this is a tough call with Sellers who have not closed in years, and was used to having a few days after closing to get the move completed.   We were one of only a handful of States that allowed the Seller to stay in a property after closing.

 

Lots to think and talk about when contemplating a "Rentback" when you thought you would take possession at closing and start the new chapter of your life.

Hi Joan... we have state-mandated forms for early possession or post-sale occupancy. I rarely do them, but knock on wood when clients needed them we had no issues.

Nina Hollander had one a few years ago that looked stellar when the buyers bought it, but never did one thing after closing - for a MONTH!   Dog poo, leaves, never vacuumed.   Never again, without a deposit!

Hello Joan - what works for one, may not work for all.  And this does not only concern people(be they a seller or buyer) but also situation and timing.  Yes, it's an option and one where much discussion needs to be a part of the conversation.

Hi Joan I am not a fan of pre or post occupancy due to the liablity and issues that comes aong wih it.  If we do one it's typically handled by an attorney and has a lot of teeth to it for both parties to perform.

Joan Cox I have enough problem with some sellers not leaving properties as they should thinking buyers will want some of their possessions they no longer need. The buyers do not want it and feel taken advantage as they have to dispose of the items -- possession at closing is best

Hi Joan Cox - It is good to have a written document spelling everything out.  I really discourage this.  I would rather see the closing date extended.  Sometimes though, that cannot be done without occurring other costs such as a lock on the mortgage rate, just to name one issue.

I always advise against this, but if my client still wants to do it then I will provide an agreement for them to execute and let them know that it will then be between them.

Anna, if at all possible, my transactions take possessions after closing, and prefer not to prepare this document either.

Grant, I think many in my area, are Sellers worried about locating a replacement home, and the days in the home after closing will enable them to locate and close on a replacement home.

Hannah Williams I have in the past too, but over the last few years, if it looks like the Seller isn't the "clean freak" we hope to have, I spell it out in the post closing document, and have not had these issues anymore.
