My last two transactions had potential hiccups that could have delayed closing or even killed the deal! Because I took care of these problems early the deals closed smoothly and efficiently
Deal #1 - Ex-husband refused to sign the quit claim deed at the divorce. I knew my client for at least 20 years and often heard stories that made me cringe. About 10 years ago he upped and left. I cheered. She kept trying to get him to sign the quitclaim deed and he totally ignored her. The divorce decree gave her the house (that she payed for with her money and earnings). In March she told me she wanted to move when her house was ready to sell but she had this problem. I got his name off the tax rolls. I thought I got it in her name. When title was pulled there he was. Nasty surprise but 3 weeks before closing. I had seen it but just figured that the county was behind because of Covid. I went into action. I called her lawyer (with permission) and found out exactly what we needed to do. We had title record the divorce decree and he was removed from title. It was good work on my part. If I hadn't read the title commitment when it came it there could have been a problem.
Deal #2 - My client bought his home in 2015 and 1 month later was transferred overseas. He decided to rent the property out and we became property managers for this property. We have been managing property since 2005. This August he decided to sell so he could buy a property for his family to live in. I contact title before we listed the property and my title officer arranged a special power of attorney for him to get notarized. This was done in plenty of time so his mother could sign for him. Yesterday she signed. He told me he had to get something notarized at the consulate and he had a 2 month wait. That would have been awkward.
So you can see how anticipating problems can help for a smooth closing.
