Don't spend your retirement account to pay your bills if you are in serious financial trouble...

I was watching CNN last night when Suze Orman came on and I happened to hear her say something that was quite important to anyone who might potentially lose their home and may eventually file bankruptcy. She was talking to a caller who had recently filed bankruptcy.  She asked the caller if they had a retirement account and the viewer said, "Yes with a balance of $60,000". 

I was surprised to hear Suze say that the Bankruptcy court can not touch funds in a retirement account.  I immediately thought about how many people dip into their retirement account when they get behind on their payments.  The long and short it is that if you are in financial trouble you should think twice before using the funds to pay your bills if a bankruptcy may be inevitable.   

I think that too many people get bullied by creditors and volunteer their retirement accounts thinking that they can somehow avoid the inevitable.  The moral is to consult a bankruptcy attorney if you find yourself facing a serious financial hardship.

Lenders and collectors will go to any extent to collect.  They have no concern for the borrower or the circumstances which have brought them to this point.  Jules, great advice!  I wonder, with the current economic trends, how many of us will enjoy a peaceful retirement without severe money worries?

Wow, that is hard to believe. I dont' watch her much, but found myself in close to those shoes. My husband after 11 years was umemployed. I was trying to start in the real estate business. (not the best time, but here I am five years later). We did file BK, but after we used all of our $30,000 in a 401. We didn't know either. I didn't want to ask because, being in the business, well, you should know what to do... NOT. I am over it now and find that my journey has hit close to home with many and I can say I do understand. So many are afraid to ask.  Thanks for the post!
