Minnesota Department of Revenue Has Voluntary Disclosure too

The IRS has a program where taxpayers can come forward voluntarily.  This program allows you to disclose a less than perfect tax history.  Often it also allows you to avoid any criminal prosecution for tax evasion and other tax crimes.  The Minnesota Department of Revenue has its own Voluntary Disclosure Program.  This program is very similar to the IRS program, but it is for state level taxes.

 

I am a tax attorney in Minneapolis, MN.  I represent taxpayers in front of the IRS, state tax authorities, and the United States Tax Court.  I help with tax debts, tax audits, payroll tax issues, and criminal tax matters.  The Minnesota Voluntary Disclosure Program can be very helpful for tax payers who want to come completely clean.

 

To be eligible for the program, a taxpayer must meet the following criteria:

 

  • Not be under review for Minnesota tax obligations by the Minnesota Department of Revenue
  • Not have been contacted by the Minnesota Department of Revenue about tax compliance or an audit; and
  • Not be evading taxes or misrepresenting your tax liabilities

 

So, essentially the eligibility requirements are pretty close to the IRS Voluntary Disclosure Program requirements.  This program can help you limit liability and avoid a criminal referral just like the IRS program.  However, the Minnesota Department of Revenue offers some benefits even to those who do not qualify.

According the the Department of Revenue Website that describes the program for the public:

"Note: If you do not qualify for a formal Voluntary Disclosure agreement, we may be able to offer you some of the same incentives in return for coming forward voluntarily. You may still apply."

 

The Minnesota Department of Revenue is willing to work with you even if you don't qualify.  That's one huge incentive for coming forward.  If you want to put your poor tax past behind you, then consider this program.
