So Why Tax Controversy and Tax Resolution?

Salt Lake City, Utah - I have been asked on numerous occasions why I do Tax Resolution Work and why do I like it.  When I started the practice of law much if not all of my work revolved around Wills, Trusts, Probate, Trust Administration, Estate Tax Returns, etc.  In doing this work as a tax attorney, I completed a number of Estate Tax Returns for Utah and Idaho residents.  In doing the Estate Tax Returns what I learned is that Estate and Gift Tax Auditors return to the IRS more dollars per capita than any other subdivision of the IRS, so audits in estate and gift tax tend to be emphasized.

These IRS auditors are typically lawyers who are well-versed in current planning techniques.  These auditors have the same resources available to them as do individuals in the private sector, and with these resources the IRS is able to stay on top of its game.

When the IRS performs an audit of an estate, I have found that more and more auditors are looking for issues of fraud, either by the deceased during his or her life, or by the trustee or personal representative in administering their fiduciary duties.  I have also found that if a trustee or personal representative has committed fraud that the criminal division for the IRS or the Department of Justice are close behind.  If the trustee or personal representative gets into rough waters, I enjoy helping them to navigate through these tough times.

20 years ago in starting with estates, we have expanded our services to help companies with payroll problems, penalty abatement, innocent spouse relief, offers-in-compromise, tax-liens, tax-levies, etc. When tax problems arise, I have found that taxpayers have a lot sleepless nights and fear in their dealings with the IRS.  I have also found that if a tax problem does arise I have been able to help people save their financial lives.
