Marching Into Trouble with Buyers

There can be many things that can get a real estate broker or agent in trouble while working with buyers. On several occasions while out showing homes to potential buyer clients, many will ask you to show them properties or homes that you have not been given permission to show. They seem to think that brokers or agents can just open any lockbox to let them in to see properties, especially vacant homes. They have to be reminded that appointments need to be made in order to see any properties, whether they are empty or occupied.

What buyers fail to remember is that agents normally only show clients houses that met their criteria for a particular neighborhood. If that property was not on the list, most likely it was not in the price range or didn’t meet other criteria that was given. Just because there is a sign in the yard doesn't mean that property is still available.

Apparently in my market area there were a lot of brokers/agents who had been showing properties without prior authorization, since the board recently announced that there will be stiffer and harder penalties for anyone who is caught showing properties without prior authorization.  Fines up to $5,000 and possible suspension of your license were mentioned in the notice that went out to all brokers and agents. Just because you have a Supra Key doesn’t mean you may open that lockbox without an appointment. Also, brokers or agents should not enter a property hours before or after their approved appointment time. Sometimes this may happen when there are combination lock boxes being used. Agents must never give out those codes to their buyers too. Agents need to always accompany their buyers on all showings too. But those Supra Key lock boxes can electronically send a message to the listing agent that someone has entered a property at a specific time. Listing agents who used Supra Key lock boxes can also set up instructions for their sellers to be automatically notified too.

It’s just easier to call Showing Time for an appointment and get approved to show any property that your buyers want to see. If you're in the market for buying homes in the San Antonio area, call Jerry at 210-789-4216 for your next showing appointment.

Jerry Newman - I wish the fines for violations in my area were MORE than what they are.

Bottom Line:  A sign in the yard and lockbox at the property alone does NOT give an agent license or the right to enter whenever they want.

Thank you for participating in the March Challenge.

Hi Anna Banana Kruchten Phoenix Broker. So glad to hear that stupid agent got what he deserved for entering your listing unauthorized. That's what I love about using our Supra Lockboxes, you can tell who enters your listings.

Hi Kathleen Daniels, Probate & Trust Specialist. Perhaps soon your local board will decide to raise fines for unauthorized entry into properties too. I thought it must have been going on to often for our board to raise the fines here. It's $1000 on their first offense.

Very good Post . Even worse is the Agent who over laps your showing with their buyers and yours is the only showing recorded on the lockbox

Michael J. Perry. Some listing agents allowed over lapping appointments last year. I have not seen many this year so far.

Michael J. Perry - That happened a lot when the market was hot. The year before last I just opened the door and the Buyer started walking around. I figured another agent was parking his car to show and it was. I locked the door and proceeded to focus on my prospective Buyer.

I did go to the door and explained we just arrived at our scheduled time and he was belligerent and that we didn't expect to be any longer than the time scheduled. He didn't care. He pounded on the door and kept ringing the doorbell thinking I was going to let him in. I called the other agent to let her know.

Hi Jerry- There are procedures and rules in place for good reasons. As a home seller, I've been on the receiving end and more than once had unexpected viewers show up.

Jerry, it always amazes me that an agent would think it was alright to just show a home without going through the proper procedure.

I hate when buyers act like that, haha.  They are the same people that when selling a home don't want to be inconvenienced with having to show it to prospective buyers, haha.

Hi Kathy Streib. I doubt if any homeowner would welcome unexpected visitors, especially agents wanting to show their homes. Have a Blessed Sunday.

Yes, Dr. Paula McDonald. I hadn't realized it was a big issue here in San Antonio until I read that noticed about our board increasing the fines on those agents who actually were entering homes without prior authorizations. Some were even giving potential renters access codes to enter properties without accompanying them.

Good Morning, Endre Barath, Jr. I know you and Kathleen would love to see heavier fines out there in your areas too. Perhaps it will give those agents a wakeup call to get there attention.

Good morning, Brian England. I have experienced those sellers who don't want to be inconvenienced to show their homes. It happens a lot on weekends. Then, they want to blame their agents for not selling their homes.

Hi Jerry:

It shouldn't surprise me to hear about some of these violations and I imagine they happen everywhere. Violators should be reported and there should be fines levied - good to see your Board taking action. The conduct you mentioned is so unprofessional and gives us all a bad reputation.

Jeff

I enjoyed the post, Jerry. As agents, we have rules of the road that should be followed. In any profession, there are those who think rules do not apply to them.
