In your last entry, we wish to say, congratulations on winning your case! Having been "the Managing Broker of a large Real Estate Office of a National Franchise affiliation, and having intimate knowledge with the law, why would anyone be bold enough to take you to court? There was no evidence that they were right and your agent was wrong. They must have been crazy to take you to court and think they could slap you in the face. Case Law prevailed and you must have felt ten feet tall after it was all over.
Wayne, even though you completed the three entries, which we are very grateful for, it would be really nice if you can provide future case studies like this so that members here on ActiveRain could learn from true stories. As agents, we cannot practice law but there are enough agents out there all over the map of the United States who know how to bully and throw their weight around.
For now, what you have shared are stories to be treasured and remembered. In business, there are always gray areas and the truth is seldom simple. Most agents are told, document, document, document. Is that all there is, or is there a blueprint or template for documenting to stay out of trouble? Truly, you are appreciated and it was so nice for to be human, and share that as a Broker, you were responsible for the actions of your agents. On rare occasions, things go haywire, for agents, and it feels like one is going into a battlefield, which is crazy and scary too. Well, I won't push the envelope. These three examples you shared were a gift.
