GOING FISHING – THE WRONG BAIT - THE LURE OF OFFERS-IN-COMPROMISE

Salt Lake City, Utah – I had a telephone conversation, yesterday, with a prospective client.  She was given my number by a family law attorney who told her that Kent Brown may be able to help with your tax nightmare.

This prospective client is going through a divorce.  During the divorce proceedings she discovered that her soon to be ex-husband’s side hustle left her on the hook for a lot of unpaid back taxes.  Instead of receiving a tax refund, she found out her refund would be used to pay the tax debt.

She is an excellent person in a tough spot.  Once people find out that they owe back taxes, they usually stay up late at night, and during those late nights they see commercials that tell them that the advertiser can settle the taxpayers tax debt and get rid of a gazillion dollars for 50 cents.  Then the commercial shows a happy couple golfing at the Ledges in St. George.  To get this perfect result, just send them $10,000 right now.  That is what this prospective client heard.

The reality is that taxpayers who owe back taxes can take advantage of various IRS programs, they can settle their tax debt for less, but there is one thing that they must understand, these options are available IF THEY QUALIFY!!!!  So, how does this prospective client know that she qualifies?  She doesn’t, all she knows is that the national tax chain wants $10,000.

So, what did we do.  We offered to perform the tax analysis, calculate the RCP – the formula used by the IRS – then show her the available options.  Depending on what she wants to do, she can apply the money paid for the tax analysis to the appropriate options and then resolve her tax nightmare.

The tax analysis is everything.  Most national chains have a 40% success rate.  We have a 93% success rate.  Why 93%?  Well, some clients lie, if they did not lie, it would be 100%. The other reason why it is so high is that we will not recommend a course of action for a client if the client is not eligible for the tax resolution option.
