There are millions of taxpayers in the United States that are in debt to the IRS and owe back taxes. There are millions more that the IRS knows should have filed tax returns that did not. As we wrap up the 2022 tax filing season, the IRS is preparing to address the millions of cases in their collection inventory and contact those who should have filed returns that did not. The Tax Gap, which is simply the difference between the amount of tax the IRS knows is owed to them and the amount voluntarily paid, is hundreds of billions of dollars each year. As the IRS properly staffs their operations and attempts to recover from the backlog of work from the Covid 19 era, they will be working to close that gap and collect the amounts that were not voluntarily paid.
Non-filers, which are those individuals who had a filing requirement but did not file their tax returns, should consider hiring a competent tax professional to represent them before the IRS. Hiring a professional who is well versed in matters pertaining to IRS collections can work with you to prepare and file all of your unfiled returns as well as help you plan to actually resolve the tax liability that you haven’t paid. Depending on your circumstances, a competent tax representative can likely reduce the liability that you owe, defend your rights as a taxpayer, negotiate a collection alternative, and properly illustrate to the IRS why you may be a candidate for Penalty Abatement or hardship status giving you reprieve from collection enforcement. Now more than ever, taxpayers should consider hiring a professional to represent them before the IRS because the new agents and customer service representatives on the phone are still learning and may not properly advise taxpayers of their rights and options when trying to deal with their tax liability.
Taxpayers who have liens filed against their property, have had bank accounts or sources of income levied, and those who have had their passport revoked should also strongly consider hiring a competent professional to be their IRS Representative. Those tax practitioners who only dabble in tax resolution and IRS Representation are not familiar with the intricate details of solving tax problems and protecting taxpayer rights. Just because someone has been preparing tax returns for decades does not inherently make them qualified to represent their clients before the IRS.
