What do you mean by Tax Compliance? When dealing with the IRS and attempting to resolve tax debts it is critical to understand that before you can reach any type of agreement with the IRS to resolve your tax liability, you MUST be in what the IRS considers to be Tax Compliance! If you are not in compliance, you will NOT be able to enter into an Installment Agreement and you will NOT be able to get an Offer in Compromise accepted! So, what exactly does it mean to be in Tax Compliance? Great question!
To be considered to be in compliance with the IRS provisions and be an eligible candidate for many tax resolution options, you must currently be in Tax Compliance. This simply means that all tax and information returns that pertain to your specific circumstances must be filed and all current tax period payments must have been made as of the current date on which you seek resolution through collection alternatives. This means that in addition to filing your individual tax returns, or business returns if attempting to resolve a business tax problem, you must have established proper tax withholding as an employee or have made your estimated tax payments if self-employed, and if applicable, you must have made your current quarter’s Payroll Tax deposits. Many clients who are attempting to deal with back tax debts are not aware of these requirements and often do not want to hear that they must currently be in compliance.
If you are not currently in compliance, you will find it nearly impossible to resolve your back tax debts. Working with a qualified tax practitioner that specializes in solving tax problems is absolutely essential if you want to succeed in negotiating the best deal you can qualify for. A great tax practitioner who knows how to deal with the IRS can help you get back into the good graces of the government and be considered by the IRS to be in Tax Compliance. This MUST be done prior to contacting the IRS and offering a collection alternative as a solution. Per IRM 1.2.1.6.18, regarding the Policy Statement 5-133 on Delinquent Returns, taxpayers normally must have filed the last 6 years of tax returns to be considered to be in compliance. If you are told by another practitioner that you must file more than 6 years, ASK THEM WHY! It is possible that filing additional years could be in your best interest, or even required by the IRS in certain circumstances, but if a tax practitioner is telling you to file more than 6 years and does not have a justifiable reason, they either don’t know what they are doing or they are trying to justify charging you to prepare more returns than are required.
The IRS and taxes in general can be complicated and intimidating. If you have received IRS Notices regarding back taxes owed and are facing potential Tax Liens and Levies, it is well advised to seek competent representation when dealing with the IRS. Most people would not go to court and face litigation without an attorney, and it is in your best interest to engage a qualified representative to deal with the IRS on your behalf.
