Medford Oregon: IRS Offer in Compromise – Let’s See if YOU Qualify!

By
Education & Training with First Response Resolution, LLC

Welcome to First Response Resolution, LLC’s official blog! We are a specialty tax firm practicing in the Rogue Valley of Southern Oregon. The focus of my practice is solving tax problems for individuals and businesses, IRS Representation of taxpayers, and representing taxpayers before their individual State Departments of Revenue. These services are referred to in many ways such as Tax Problem Resolution, Tax Relief Services, Tax Resolution, IRS Resolution, Tax Controversy, etc. Think of our firm as your Financial First Responders who specialize in saving troubled taxpayers. We help people who are struggling with tax problems get their lives back on track so they can focus on what matters most to them.

If you are considering an IRS Offer in Compromise to settle your tax liabilities and solve tax problems, First Response Resolution, LLC will conduct a financial analysis to determine if you qualify, BEFORE you commit to this tax resolution option. Wouldn’t you like to know the options that are available to you and whether an Offer in Compromise would be accepted by the IRS to resolve your tax problems BEFORE you spend thousands of dollars for a representative to negotiate this deal with the government? This is the reality for all of our clients! We ALWAYS conduct this analysis to determine the BEST strategy before we charge clients for the implementation of the chosen strategy. We bill in two to three phases: The Investigation and Financial Analysis, Getting our Clients into Tax Compliance (if necessary), and then the ultimate Resolution. This ensures that taxpayers do not spend thousands of dollars before they know if a strategy is available to them AND that the chosen strategy is the BEST strategy for them and their goals.

Investigation and Analysis: this consists of obtaining your tax transcripts from the IRS, evaluating the details of the transcripts to identify the Collection Statute Expiration Dates of any tax years that represent a liability, identifying any compliance issues that need to be remedied, and searching for potential opportunities to reduce or eliminate tax owed, including penalties and interest that could be abated.

Getting into Compliance: In order to resolve your tax liabilities through many collection alternatives, taxpayers must be in compliance in the eyes of the IRS. This means that any tax returns that were required to be filed must be completed and filed, and you must be current on your estimated tax payments or have sufficient tax withholding from your wages for the current tax year. If you are resolving tax debts of a business, you must also be up to date on your current and past 2 quarters of Payroll Deposits. To be eligible for an Offer in Compromise, you must also NOT be in an open bankruptcy proceeding.

Resolution: Once the BEST option available to you is determined and agreed upon, First Response Resolution, LLC will prepare all of the required Forms and documentation necessary and submit the proposed solution to the IRS. We know how to prepare substantiating documentation to give the IRS everything that they NEED to be able to agree with our proposal. If the initial response from the government is to reject the proposal, WE WILL APPEAL that decision on your behalf. This is because we do not propose solutions to tax problems to the government unless we KNOW that the tax laws and IRS procedures specifically allow the conditions that we have proposed. The Independent Office of Appeals is often where taxpayers are able to make their argument before IRS staff that are both well trained and have discretion and authority to AGREE with the proposal.

Stay tuned for our next post in which we will discuss the Pros and Cons of submitting an Offer in Compromise to the IRS. There are times when this option is an absolute life saver, and others where you may have BETTER OPTIONS. The only way to KNOW the best solution is to conduct the investigation.

The IRS and taxes in general can be complicated and intimidating. If you have received IRS Notices regarding back taxes owed and are facing potential Tax Liens and Levies, it is well advised to seek competent representation when dealing with the IRS. Most people would not go to court and face litigation without an attorney, and it is in your best interest to engage a qualified representative to deal with the IRS on your behalf. If you or someone you know is in the midst of an IRS issue, contact me at either 541-293-8449, by email at zach@firstresponseirs.com, or through our website. We specialize in solving tax problems! We know how to defend taxpayer rights and will thoroughly investigate and evaluate your specific situation and consider ALL OPTIONS available to you. All discussions are kept strictly confidential, and we offer no obligation initial consultations of up to one hour.
