Senate Bill 23-206 Requiring Disclosure of Radon Information for Residential Property Agreements

 

As of Tuesday, June 6, 2023, Colorado joined the majority of states that require a radon disclosure statement to residential property buyers and tenants with the passing of SB23-206. Radon is responsible for nearly 500 lung cancer deaths every year in Colorado, yet exposure to radon can mostly be prevented through proper testing and mitigation. 

 

What the New Bill Requires

Key disclosure requirements for all residential property sale contracts:

  • Any radon testing that has been conducted on the property
  • The most recent records and reports on radon levels detected at the property
  • A description of any radon levels detected and any treatment or mitigation or remediation performed
  • Any information regarding whether a mitigation system has been installed
  • An electronic or paper copy of the most recent information from the Department of Public Health and Environment to advise about radon in real estate transactions
  • Tenants can break their lease with no penalty if the rental property owner chooses not to fix a property that has confirmed elevated radon level with a professional test

Probably just a matter of time before this spread to Oregon, Will.  We don't have an issue with Radon in Central Oregon, but I have heard of some positive tests in the Portland market.

Will, Fortunately, Radon isn't a concern in our area, but I've heard that conducting tests is essential in other regions.

Thanks for sharing Bill. It is an invisible carcinogen and therefore health hazard. Radon has been a question on our state sellers disclosure since I  can remember (1999 is the year I became licensed).

I wish our state of Maryland did this....  we have to test when a property is sold and now rentals have to be tested whenever they turn over
