As of June 26, 2023, public school teachers in South Carolina are eligible for 6 weeks of paid parental leave. This applies to teachers who give birth or become parents by adopting a child under the age of 18. The spouse who does not give birth or — in the case of adoption, the parent who's not the primary care provider — can also take two weeks off with pay. Parents who foster a child in state custody can also take two weeks of paid leave.
The law was signed by Governor Henry McMaster on May 13, 2023. It was the first law of its kind in the southeastern United States.
To be eligible for paid parental leave, teachers must have worked for the school district for at least one year and must have accumulated at least 120 sick leave hours. They must also provide documentation of the birth or adoption of the child.
The paid parental leave can be taken all at once or in increments. It can also be taken before or after the birth or adoption of the child.
The law is funded by a combination of state and local funds. The state will provide $1 million in funding for the first year, and local school districts will be responsible for the remaining costs.
The law is expected to benefit an estimated 20,000 public school teachers in South Carolina. It is seen as a way to attract and retain qualified teachers and to support new parents.
