FILING a proof of claim:
Unless the bankruptcy notice indicates that a chapter 7 petition was filed as a no-asset case, you should PROMPTLY file with the Courta proof of secured claim evidencing with this proof of the debt owed, including: BOTH, total debt AND arrearage (past due ) debt. (The bankruptcy notice usually will indicate if this is necesary.)
Once you have been advise of bankruptcy proceedings involving a Main Deository National Lending Institution, you must report the status of the mortgage to them no later than the NEXT Report, using the corresponding action code.
Report as action date the date that the repayment plan will expire, or the anticipated date by which the bankruptcy will be resolved, which CANNOT be more than 36 MONTHS IN THE FUTURE. IF, only IF it takes longer than 36 months to resolve it, you will need to provide the actual date of resolution or a neww anticipated date at the END of this 36 months period.
