Love them or hate them, if you're buying a home within the confines of an HOA, you need to understand the rules before completing your home purchase. Your Realtor can provide you with a copy of the Rules and Regulations (Restrictive Covenants) before you consummate your purchase. Below is an excellent article of items to be aware of before you complete your home purchase within an HOA.

Buying a Home in an HOA?

Are you considering a home in an HOA? Before you finalize your contract here are a few questions you should be asking:

  1. What are the HOA fees and what do they cover? Do the fees cover street maintenance or are the streets county streets? Who handles snow and trash removal?
  2. Are there any upcoming assessments?
  3. What are the rules and regulations of the HOA?
  4. How is the HOA managed? And, by whom? Are there regular HOA meetings? When are they held?
  5. Are there any restrictions on renting out property or doing short-term rentals, like AIRBNB?
  6. What is the process for making changes to your property?
  7. How are disputes resolved?
  8. What amenities are available and how are they maintained? Are there extra fees for amenities, like a community pool?
  9. Is there a reserve fund for major repairs and replacements?
  10. Can you review the HOA's financials and meeting minutes?  

These are just a few questions you should ask when you are purchasing a home located in an HOA, and if you don't like the terms in the HOA resale package you can withdraw your offer and move on to another property.

Thanks Michael Elliott and June Piper-Brandon - most unhappy homeowners just go to social media to express their displeasure, but rules are in place for a reason. As a Realtor, I certainly understand the reasoning behind HOAs, but I've also seen some directors go on a power trip and be over-zealous over enforcing the covenants. I'm all for a happy medium. :)

George Souto , I am quite sure you keep your yard mowed and flower beds weeded, which is a huge benefit of living within an HOA. Not all neighbors keep their yards maintained so the HOA is a nice reminder to get it down. Boat parking, on the street parking, etc., is another common nuisance.
