"City inspectors have begun ticketing Atlanta real estate agents, holding them liable for code violations on run-down, often foreclosed properties..." says the Atlanta Journal-Constitution!

What next? Are REALTORS to be held libel for sellers bad decisions?

If this were applied to law, defense attorneys would have to serve time with their clients! Hummmmm

I think that is crazy.  They cited Rick Hale, an agent who used to be in my office.  It says he actually paid the $3300 fine.  It was on a $12,000 listing with an unpaid $150,000 water bill.  Who's going to take on those listings now?  I surely wouldn't.  I guess it will be better with the homes sit there and deteriorate over a few years.

This is just an example of how messed up the city government is in Atlanta.  What a joke.

Agents who take on the responsibility for foreclosed properties are accountable to the lender to maintain the property. It is in the listing agreement they sign.   So if there are letting the property fall into disrepair, let the yards grow wild and are not doing the required property checks then they should be held accountable.  Maybe this will be a wake up call to agents to do what they signed up to do with the lenders and if they can't then they need to get out of the foreclosure business.

How can the Realtors be held liable for the condition of someone else's property?  It would be the same as holding the mayor personally liable for a pothole in the street causing a car accident.  Or an attorney being held liable because his client punched the judge in the nose.

I have to agree that agent need to take some responsibility's for their listings. If you take a foreclosure listing you take on the responsibility on behalf of the bank and if you mange the listing don't take it .

We as agents have to stop sticking our sign in a yard and expect a check and nothing else

Please show us such a listing agreement. I've never seen such a contract. I've never seen a management contract that could cause this.

The problem is that when  they attack us one by one, no one indivual can afford to fight.

Surely we must hang together, for individually we shall surly hang! Atlanta isn't the only city with REO problems.
