Exactly. Board of Health Approval (BOHA) just confirms that a septic system has been approved for a particular lot, but it doesn’t guarantee that a house can be built. There are plenty of other factors to consider, like:
- Zoning Regulations – The lot still has to comply with town zoning, setbacks, and lot size requirements.
- Wetlands & Environmental Restrictions – Even with BOHA, protected wetlands or conservation easements can prevent building.
- Access & Infrastructure – If the lot lacks legal road access, utility connections, or adequate drainage, it may not be buildable.
- Building Permits – You still need town approvals for the actual structure, which can involve engineering, architectural plans, and meeting code requirements.
- Site Conditions – Steep slopes, bedrock, or high water tables can make construction impractical or require expensive site work.
I’ve seen plenty of people get excited over a BOHA lot, only to hit a wall when they try to pull a building permit. Have you come across a situation like that?
