Nudist Community Seeks HUD Approval for FHA Loans, No Suits Required?

In the spirit of summer, let’s revisit an old RSL favorite and dive into a unique condo approval case that raises an interesting question:

Can a nudist community qualify for FHA financing?  🙈😳😅

Condominium projects come in all shapes and sizes, and this one is certainly… a little different. This particular community is a well-maintained, financially sound condominium that meets almost all FHA eligibility requirements. The units are in FHA’s pricing “sweet spot,” the project’s financials are solid, the owner-occupancy rate is nearly 100%, and residents are up to date on their common charges. Demand is so high that there’s a waiting list for new buyers. On paper, it looks like a perfect candidate for FHA project approval.

However, there’s one unusual hurdle. The condominium is a nudist community. Surprisingly, this alone does not impact FHA eligibility. What does? A requirement in the community’s governing documents that all unit owners must maintain membership in a regional or national nudist organization.

Why Does This Matter for FHA Approval?

Under the National Housing Act, condo associations cannot require unit owners to join an external club or organization as a condition of ownership. This is similar to a condominium mandating membership in an affiliated golf club or boating association—FHA won’t approve a project with these types of restrictions.

Because of this rule, the nudist community is currently ineligible for FHA approval. Some residents have expressed frustration, believing the decision is discriminatory. However, nudism is not a protected class under federal fair housing laws, and the issue isn’t nudism itself—it’s the mandatory membership requirement that violates FHA guidelines.

How Can This Condo Become FHA-Approved?

The solution is simple: If the community removes the mandatory membership clause from its legal documents, it could become FHA-eligible. This would open up financing options for buyers and make the units more accessible to a broader range of homebuyers.

Hmmm, I assume the HOA wants to make sure like minded people area moving in, hence the requirement. There must be a way around it that would make both the FHA and the HOA happy. I don't know what it is, but I'm sure there's a solution!

Hello Neil - thanks for laying out the bare facts of this situation.  Belonging to a HOA community is not the right fit for everyone and it seems each association has their own quirkiness (for lack of a better description) that may be a cause for concern.  An enlightening post.
