Does a Post-Closing Seller Contingency stop Buyers?

One of my listings asked how long they had to find a home out of state.  Good question!   I told them, probably 30 days for the transaction, and you can probably safely write on one after their inspection dates have passed.   But, they will be financing, so they will need to wait 30 days most likely for possession of their new property.

So, after a bit of conversation, they asked for 30+ days after closing so they have a place to live.  They do have dogs, and many short-term rentals will not accept large dogs, so they would not have a place to live.    Can't do that!

And, one of the showings over the weekend (so far) said they needed possession at closing, and couldn't give any days after that.   

Have heard from a couple of others who have time, and don't have any issue with allowing the Sellers more time to locate their next property, thankfully.

I was wondering how much affect this contingency would have on showings and offers.

Good morning, Joan... it's very rare that I see a buyer possession before closing or a seller possession after closing request. Our attorneys strongly advise against those. A seller possession is usually less risky so every so often we do see one of those.

Hello Joan - some buyers seem to "stop" at many sorts of things in real estate.  Those who want to purchase a property are quite willing to move forward and find a way (or ways) to negotiate a successful transaction.

Generally I have little problem if the home is under contract and passed the inspection date. It usually means we have a 95% chance of closing. I will rarely have my buyers accept an offer that requires the owner stay in the home more than 3 days. I feel that it is the seller's responsibility to handle the details of things like dogs, new location buying, etc...

Nina Hollander, Broker they can be risky, but the last few times I have had Sellers remain in the home after closing, it all worked out for both parties.

A seller request may have a chance of succeeding but most likely an escrow will be involved for any damage

I saw lots of sellers during covid getting free lease backs for even up to a month. That is not the norm now...maybe a few days past closing and that is it.
