Thankful for... "Jim"

This month, the ActiveRain challenge is about thankfulness, which is of course quite timely since it's November, the month of Thanksgiving. Our host, Lynn B. Friedman CRS Atlanta, GA 404-617-6375 has indicated we can share someone's thankfulness FOR us, or our thankfulness for someone else. Specifically, someone who may have been helpful in our real estate role.

I met the first person that popped into my head at the very start of my real estate journey.  It was at one of my courses that were preparing me to become a real estate agent. This one particular day, an attorney was coming in to speak to us about an attorney's role in real estate.

So when we got to that part of the class, the attorney who was speaking to us (let's call him Jim), started sharing his thoughts with us. Unlike many of the other speakers who were somewhat dull, Jim was lively, entertaining and made me laugh. But he was also full of useful bits of knowledge regarding how things really worked. And then as his presentation was winding down, someone asked him a question...

"Are you a butt kicker at closing? Do you give the other side hell?"

And his answer made me want him as MY attorney. He shook his head and said..

"At closing? No, never. By closing everything should already be identified and resolved. Closing is just intended for signing papers and transferring ownership."

And why did that make such an impact? Because that's exactly how I thought the process should work. But after seeing and hearing of many disastrous closings with attorneys arguing at the closing table, I realized how rare his statement was.

So what then?

Well, I used him for multiple personal real estate transactions, and wound up referring him to many of my clients along the way. And he was always true to his word. Everything got resolved prior to closing and there were never any surprises. I continued to work with him until we moved out of state. Why? Because he was an rare find and was truly a man of his word. Thank you "Jim."

Kat that was very wise advice he gave to your class.  AZ is not an attorney state and agents/brokers are considered 'attorneys in fact".  I've never had issues at closing because everything has been worked out well in advance.  I'm thankful for that.

Great story, Kat. I believe in a collegial approach in working with other agents, attorneys, inspectors, etc. Kicking butt and giving the other side hell generally does not move a process forward.

Butt-kicking at closing? I've never even heard of such a thing. Any disputes should be in the rear-view mirror.

Kat Palmiotti - That was a good question and a great answer by the attorney too! I can understand why it was easy to build trust with him for many years. When some words ring true, they are hardly forgettable. When getting into the business, we all need someone to give us a good kick start!

Texas is not an Attorney State - We are Escrow. However, many Title Companies use their attorneys to provide Continuing Education. The first one that I connected with had the intelligence and human factor like Garry Spence - my favorite real attorney from Wyoming/Author. I have a collection of his books that I will never part with.

In AZ, we are not an attorney closing state. However "Jim's" words of wisdom is 100% true. All sales obstacles should be removed prior to closing so that on COE day it is truly just signing of documents. Great example of thankfulness.

My experience with attorney states is there is no sense of time is of the essence. Closings take a lot longer as the attorney may decide to go on vacation. Yes that happened to one of my buyers from the East Coast.

Now that is one gem of an attorney, Kat! When you find one like that, you do hold onto them forever. I have 2 here that operate like that and even when there's a 'dispute,' it is handled with respect and an offer of assistance.

I have dealt with many agents who always seem to bring the drama and want to be 'in control.' My secret sauce is killing the other side with kindness when they bring the drama. Most often, that brings the peace!

Jim was certainly the right attorney for your real estate transactions. He did not need to bully anyone to prove that he was "the man". He knew that a smooth and satisfactory transaction was everyone's desire.
