Beware of “For Sale By Owner”: The Risks of Buying Land in Lake County with Misleading Information

Purchasing land can be one of the most rewarding investments, especially in scenic areas like Lake County. However, buyers must exercise caution—particularly when dealing with “For Sale By Owner” (FSBO) listings. While FSBO sales may seem appealing due to the potential for lower prices and direct negotiation, they often come with hidden risks, especially when the seller provides inaccurate details or misrepresents the location of the property.

The Dangers of Misleading Information

One of the most common issues in FSBO land sales is the lack of accurate documentation. Sellers may unintentionally—or in some cases, deliberately—provide incorrect parcel numbers, zoning details, or property boundaries. This can lead to serious consequences for buyers, such as:
- Purchasing unusable land due to zoning restrictions.
- Legal disputes with neighboring property owners over boundaries.
- Unexpected costs for surveys, title corrections, or legal fees.

In Lake County, where land can vary significantly in value depending on proximity to lakes, towns, and infrastructure, even a small error in location can drastically affect the property’s worth and usability.

Misrepresentation of Location

Another major concern is the misrepresentation of the land’s location. Sellers may advertise a parcel as “lakefront” or “near town” when in reality, it’s miles away from any desirable amenities. Without proper verification, buyers may find themselves owning land that is:
- Inaccessible or landlocked, with no legal road access.
- Far from utilities, making development costly or impossible.
- In a flood zone or environmentally protected area, limiting use.

How to Protect Yourself

To avoid these pitfalls, buyers should take the following precautions:
1. Hire a licensed real estate agent or attorney familiar with Lake County regulations.
2. Verify all property details through the county assessor’s office or GIS mapping tools.
3. Order a professional land survey to confirm boundaries and access.
4. Conduct a title search to ensure there are no liens or ownership disputes.
5. Visit the property in person to assess its true location and condition.

Final Thoughts

While FSBO listings may offer tempting deals, the risks of misinformation and misrepresentation are real—especially in land transactions. In Lake County, where location and land use are critical, buyers must be vigilant. Working with professionals and doing thorough due diligence can save you from costly mistakes and ensure your investment is sound.

Currently there are several parcels in my area “For Sale By Owner”. 2 of them do not meet the setbacks and appear to have wetlands. The other one is posted in the wrong location, the for sale by owner has been informed and they state that they have the right location. The parcel ID and name indicate wrong location.

In your best interest, contact a professional Real Estate Agent/Broker who services the area and can lead you in the right direction.

Michael Jacobs I am not sure if the title company would know the right or wrong location of the property. A surveyor could mark the right parcel and the buyer is already out of pocket. Buyers must be careful and be wise.

I am getting quite a few calls from fake sellers (they often choose out of area owner land lots). They pretend they are the owner and want to sell. So many scams with land lots as well. Be careful!

I always ask for a copy of a drive's license, phone, email, etc. If they hesitate or don't provide, I move on to contact the real owner. Our county provides a link to register to protect or make aware of any recorded deeds on our properties.

Dorie Dillard Austin TX I actually found one seller on the Z while I was looking at something else. I know who the seller is and the location of the property. The owner describes it so wrong, but makes it so appealing in his description. For sure Buyers need to beware.

There is a book, "Dirt Rich" by Mark Podolsky, that is gaining some traction.  Basically, the book teaches you how to purchase land and sell it FSBO with seller financing to create passive income.  Buyer beware!  Due diligence and representation are super important!  The book is interesting, but I can see how some could get hurt in the wallet on both sides of the transaction.

Hi Katina,
Let me tell you one story about what happened to a seller who had bought a FSBO, without an inspection.
The home was listed with another agent, and when the inspection was done for my buyer, the inspector came out from under the house and said, "The sewer was never hooked up. It's all running under the house". Ewwww!  The seller had to pay about $10,000 to have a mitigation company come clean it up.  Saving money is often penny-wise and dollar-foolish.
