Why the “No-Commingling” Rule Was Repealed

The rule called the “no-commingling” rule made it so that listings on a multiple listing service (MLS) could not be shown together with listings from "other sources". Does Other Sources mean FSBOs? It was optional and only about a third of MLSs even adopted it.

Then, in June 2025, the National Association of Realtors (NAR) officially repealed the rule. Why the change of policy? Home Buyers apparently drove that decision.

Because home-buyers wanted an easier search experience, and technology had advanced, and there were legal concerns about the rule’s fairness, and because NAR has just weathered a number of lawsuits. When you layer all that together, the rule looked outdated. So now it appears that websites will be more able to post FSBOs mingled into the MLS listings.

Good for sellers?
