Most, if not all, products come with a label. It's always good to read it whether it be food, an appliance, or medicine. But what about a home? Where is the label?

If you are hunting for a home the good news is most homes, even older homes have a label IF they are being offered through a Real Estate brokerage. In a way it reminds me of a "care for" label on an article of clothing. This label is called a Sellers Property Condition Statement. It does have other names but if you "Google" it and ask for an image it will look much like this one. Click on the graphic for a link to download a free copy.

Please note that it is rare that a For Sale By Owner (FSBO) will offer this report. Often this statement is the reason they don't sell their home through a Realtor. They do not want the legal obligation of telling you about the homes faults.

If you are considering purchasing a FSBO I highly recommend you you download the report above and ask the Seller to fill it out, If he/she refuses I suggest you run and don't look back.

This is a legal forum that gives you legal rights in case a Seller has lied to you about a properties condition. The value of such forums are immeasurable.

Good morning Bob. As an old timer I was active when "Property condition disclosures" came into being as voluntary and eventually become required. It took some effort to get sellers to comply. Was it worth it, damn right. Enjoy your day.

I also remember it well Wayne Martin BUT as a Seller. I was selling my home in Underwood ND. It was at least 100 years old and had a field-stone and concrete basement with asbestos shake siding. I had lived in the town about 10 years and new little about the history of the house other than it once belonged to a doctor.

 

I refused to complete the forum because I was afraid if I missed something I would get sued over it. I was not trying to hide anything, there was just so much to list I thought if I missed one little thing I'd be liable, lose money, or even worse and lose all my future income as well. I did make an abbreviated version saying "this is the history of the 10 years I owned it".

It was a great house and I wish I could have brought it to Minot but I could not afford that.

Hi Bob... FSBO or not, here in NC the contract requires a seller to provide a property disclosure form within three days of ratifying a contract. The issue is rarely if a disclosure is available however a home is sold... the issue is how well it's been filled out. And most disclosures I see are rubbish.

I like the analogy you use regarding the label and the sellers condition report. Ours in PA is now 12 or 14 pages long. My advice to sellers is always if in doubt, disclose it. It is much better to disclose and let the buyer know it was remedied and when rather than just presuming it was remedied so I do not have to disclose it.

A good comparison. The seller’s property condition disclosure really does function like a label for the home, giving buyers a clearer understanding of what they are purchasing.

These disclosures help bring transparency to the transaction by identifying known issues with the property before the buyer proceeds too far into the process. They also help protect both parties by documenting what the seller knows about the condition of the home.

Your point about asking for a disclosure when dealing with a For Sale By Owner property is also important. Buyers should gather as much written information as possible and rely on inspections and professional guidance before moving forward.

Taking the time to review the “label” on a home is one of the smartest steps a buyer can take before making such an important investment.

Disclosures are required in Texas. Agents must never fill out the disclosure. Buyers review the Seller's Disclosure before they buy - it's part of due diligence; then sign and return to the Seller's Agent. If something changes before the new buyer closes, they need to disclose with an Amendment, and everyone has to sign.
