This is interesting. I know most agents in my market are not paying attention to this because the agents aren't directly handling this (attorney's and title company's would have been) with most agents only getting involved if there is a problem. I prefer to pre-frame any issues far in advance- so this was something of interest to me. And of course, I dealt with FinCEN in my prior career in finance.

Hi Adam,

I agree that most agents are leaving it up to the closing agents.  However, in certain markets, real estate brokers should be making their agents aware things that could affect their buyer clients (depending on the final outcome of the expected appeal).

Yep. FinCEN changes had a huge impact on my market back in 2016 ($3m and up requirements for cash purchases). I wasn't anticipating this rule to have anywhere near the impact of the 2016 rule changes, it would still have some impact even though agents had a minimal role with the attorney's and title people handling the actual work involved. That said- my market is complicated enough- so I  am happy to see this get quashed.

Our title companies were handling this in Colorado too, so interesting it was vacated.
