Say It Ain’t So! Short Sales Are Coming Back.

 

As painful as this is to write, short sales are again on the rise and will become prevalent across markets in the United States. Many buyers who purchased high, back in the Wuhan Flu days, are unable to sell without taking a huge loss or have lost a job, are experiencing the onset of a severe illness or going through divorce.

 

As the market shifts, I’m seeing more short sale opportunities popping up and whether I’m working with buyers or sellers, it’s clear these deals require a different mindset. Short sales aren’t the typical transaction, they come with longer timelines, lender approvals, extra paperwork and plenty of uncertainty.

 

 

 

For sellers

Prepare them for a lot of of documentation, financial disclosures, hardship letters, tax returns, bank statements and more. Respond quickly to lender requests and encourage them to talk with a real estate attorney and tax professional about credit impact, potential deficiency judgments and tax consequences. Avoid giving legal or tax advice but make sure they get the right kind of help.

 

With buyers

Set expectations right from the start. The seller can’t approve anything alone, the lender might counter or reject the offer and the property is almost always sold “as-is.” These deals take longer, sometimes much longer, so talk through flexible closing dates, financing deadlines and the emotional side of waiting. Never promise lender approval until it's in writing, signed and delivered.

 

Patience and clear communication aren’t just helpful. They’re essential.

 

Keeping everyone updated, manage deadlines carefully plus reviewing every document, matters greatly. Also make sure to be very familiar with all necessary addendums and required paperwork on the lender's behalf, which is a must for protecting clients and managing risk.

I am seeing some in Florida and that's not surprising due to the last several years of a market frenzy. I dealt with foreclosures and short sales many years ago.  Although, I hope it doesn't come to that, I am ready and able.

Some people think when you give such advice, it's a Chicken Little story, when in reality, the signs are there, Adam Feinberg. Prior to that last down market, I tried to tell a builder what was happening. Instead, he looked for a scapegoat to blame rather than face the reality of bad decisions. It hit him hard!

Wanda Kubat-Nerdin - Wanda Can! Absolutely accurate! It's a bit different with me. I accurately called stock market crashes from 1987 forward (I was 13 back then). In 2006 I said we were about to have a crash unlike anything our generation had experienced- but it would take a lot of time before it became obvious and I expected it to take 2 years. I was off by a few months- but considering I made that call 2 years prior- I am still categorizing it as an accurate call. 

The key is to look for an imbalance and ask have we crossed into unreasonable conditions and to see past all the "positive" headlines that were better indications of greed and fear of missing out. You don't need a finance or economics background to see it (though of course it helps). In 2006 when I made the call about the economy moving toward collapse- it was 1 headline that convinced me we weren't simply in boom times and the sky was going to fall- no Chicken Little false equivalences. The headline read something like "50% of new mortgages issued in California were Interest Only"....Woah! I think an interest only mortgage can be a spectacular tool for the right person...but half of all mortgages being issued in California???? No, that was enough to push me into panic mode. I also knew that none of this was going to become apparent to the masses or even many experts quickly because they were financially and mentally invested in the continued success. The movie "The Big Short" was pretty accurate in capturing the mentality. The book the movie was written by Michael Lewis- who started his professional life at Salomon Brothers- where he was placed in their graduate training program with one of my former bosses (who was later among a handful of alum that was part of one of the largest and most famous/infamous hedge funds in the world). Michael at one time wrote an article in the NY Times whether he was better off changing careers to become a writer rather than to have stayed on Wall Street like his follow alum in the Salomon Brothers training program (he was referring to Hans- who I worked for many years later). Hans had made a fortune, lost almost all of it, and then made it back and then some. Salomon Brothers was the place to be to mold the best of the best talent on Wall Street back in the day- so Michael Lewis has some real credentials.

For many agents, short sales are not a niche they willingly embrace, Brian England but some will do it for their own survival in the industry. Back when taking them on, I made sure to know everything possible about helping people. Sometimes, the banks, at the last minute said no and it was devastating for sellers who hoped for acceptance without foreclosure!

Wanda, Thank you for an informative description of the reality that agents and their clients need to know. We have learned fmon the past Wild West of Short Sales when banks did not have consistent policies, working it out as it happened, and at least one national bank wanted a $2,000 "contribution" from an agent!

What goes up must come down in real estate, George Souto, especially when demand overtakes supply and high emotions take over. The ones who exponentially overbid are good candidates for short sales!
