The Most Legal Hotline Code of Ethics Complaints

Last week I attended a Texas REALTORS® board meeting, and we heard from our legal team regarding the most common topics/complaints they receive on a regular basis. They said without hesitation that they hear more issues with Articles 1, 12, & 15. 

Let's take a look at what these articles represent:

ARTICLE 1 - DUTIES TO CLIENTS & CUSTOMERS

A REALTOR®'s primary duty is to protect and promote the best interests of their client, while still treating everyone involved in the transaction honestly and fairly. This means putting the client's interests first, maintaining confidentiality, providing competent service, and exercising loyalty throughout the transaction.

Bottom Line: Client first. Honest with everyone. While this seems like it should be a non-issue and a level of professionalism that every REALTOR® follows, sadly it is not.

ARTICLE 12 - TELL THE TRUTH

REALTORS® must be honest and truthful in all advertising, marketing, and communications. All representations should present a true picture of the property, the services offered, and the REALTOR®'s identity as a real estate professional. Misleading advertising, deceptive social media posts, or false claims violate this Article.

Bottom Line: Be truthful in everything you say and advertise. Again, this one should be a no-brainer. 

ARTICLE 15 - RESPECT FELLOW REALTORS®

REALTORS® must not knowingly or recklessly make false or misleading statements about another real estate professional, their business, or their business practices. Ethical disagreements should be handled through proper channels—not through gossip, rumors, or disparaging comments. This applies to conversations, emails, social media, and other communications.

Bottom Line: Compete fairly. Never spread false or misleading information about another REALTOR®. This is the one that is so difficult and creates the most unfortunate issues between agents. This article is a reminder to be MINDFUL of the things we say about another agent. Is it true? Is it important to share? 

In my 2+ decades of being in this business, I have been involved with a few Article 15 complaints. It was not fun, but were entirely necessary. We all have reputations and livelihoods at stake. 

Bottom, bottom lines:

  • PUT YOUR CLIENT FIRST
  • TELL THE TRUTH
  • TREAT OTHER PROFESSIONALS WITH RESPECT

It's always a good idea to review our professional Code of Ethics from time to time. Let's all play nice in the sandbox. LIV2DAY!

Good afternoon Dr. Paula McDonald a great reminder for all of to maitain respectful to one another. Always put our clients first and tell the truth. False advertising can have major consequences and at the end of the day, it is not worth it.

Hi Paula,
Sadly, this doesn't surprise me. After spending many years in real estate, I came to understand that our reputation is the most valuable thing we own. Putting the client first, telling the truth, and treating fellow professionals with respect shouldn't be difficult concepts. As for Article 15, we can disagree, compete, and even have difficult transactions without tearing one another down. Professionalism matters.

So glad to see your post featured in Carol Williams Saturday Series. It never ceases to amaze me that we need to be reminded of our code of ethics in real estate estate. Clients ,first, tell the truth and treat fellow agents with respect just seem like a given!

Those are all such simple concepts that you'd think there would be no problem with them. Unfortunately, some people simply can't be honest.  I once worked alongside an agent that the broker's wife described as someone who "Will tell a lie even if the truth would suit her better."  As Jim Rhone said: "Liars lie." 

As for gossip and backbiting - those also seem to be stuck in some people's DNA.

As a member of our Grievance Board here in Charlotte, we hear a LOT of those same complaints as well as Article 9. It's so easy to do the right thing but, evidently some folks have great difficulty doing that! Thank you SO much for sharing this here. A great reminder for all, Paula!

The realtor that works for the owner of the commercial space I lease-- called me and told me that the rent was going up considerably. I told her no way, and then she said, well let me see what I can do. And then proceeded to act like she was my agent acting on my behalf!

All must be taken seriously, Paula, I do agree, for the better good of the entire organization. Elevating training standards for new agents (and mandatory refreshers for experienced agents) reduces NAR ethics complaints in a perfect world!
