AGREEMENT TO VACATE
Agreement between ____________________________________, Tenants, who occupy a dwelling located at ____________________________________________________ and ________________________________________, Owners, who are the owners of this dwelling. Tenant acknowledges that no one other than those listed above currently occupies the dwelling. Tenants occupy this dwelling under a rental agreement dated _______________________. This agreement is ( ) month to month ; ( ) a lease expiring __________________.
The current rent for this dwelling is $ ____________________. The current late fee is $ __________________. As of this date, tenants have paid rent through the following date: ____________________. They owe owners a total of $______________, itemized as follows: __________________________________.
Tenants agree that they have no excuses or defenses for failing to pay what they owe. The tenants agree to vacate the dwelling on or before ________________ at __________ pm/am.
If tenants do vacate as agreed above, owners agree to the following:
•(1) to apply the tenants' security / cleaning deposit to the amount owed and to waive the balance of any amount owed; any excess remaining from the security / cleaning deposit after the full amount owed had been paid in full shall be returned to the tenants after they have moved out completely, provided that they leave the dwelling reasonably clean and undamaged;
•(2) to release tenants of any further obligation to pay rent under the lease (if any);
•(3) to make no report to any credit reporting agency regarding tenants' credit;
•(4) to make no report to any eviction reporting agency regarding tenants' tenancy.
If tenants do not vacate as agreed above, this agreement shall be null and void, and owners may begin eviction proceeding immediately.
Tenants agree to keep this agreement confidential between the parties involved. If tenants fail to keep this agreement confidential, this agreement shall be null and void.
