I flipped a FSBO, who's flipping my signs?

I got a referral from another agent on here...thank you...for a customer in my general area. The customer was working with Buy Owner and also their sister company who lists on the MLS.

It took her over $6K and much frustration to finally get released by this company who lists for the Buy Owner sellers, when they agree to pay 10% of the listing price of the property.

The broker (listing agent) of this company never returned her phone calls, didn't provide the goods as per the contract she signed and the money she paid.  After contacting the state and various other's, she was finally released.

NOW, I have the listing...my sign is alway's being cut down and left on the ground. I REPEAT, it is being CUT down. I have used two zip strips on each side.

That being said, the neighbor's told my seller's today that the previous agent has been coming by and cutting down my sign.

How would you handle this issue?

This agent never answered her phone call's, do you think this person would answer mine?  Even if this person answered, what would you say?

I think I will file a police report and let the police talk to the neighbors...Thank you though...

I think this person is crazy...I mean really if he's going to go to the trouble of cutting it down and leaving on the ground...what is the point? At least it's still there and didn't become a flying object...

Karen, of course your approach is correct and the logical thing to do. But when someone goes out of their way to be a jerk and be destructive (and a baby to boot) it's my gut reaction to teach them a lesson. This guy needs to be taught a lesson. Hopefully the police will be able to put a scare into him, but people like this usually think that they can get away with anything.

Yes, I am the Consumers Advantage Mortgage guy.  I thought of one even better... you could post it to YouTube. To me that would be more rich that getting them in trouble with the law.  I don't think it's a crime to post a home video to YouTube. :)

So, Anthony, How would I do that? So video the person cutting down the sign...I'd have to take a sleeping bag there and stay there every nite...and I live 30 miles away from this property.

You want me to be an accomplice? :) Obviously you don't want to make it troublesome for yourself. It may not be worth the gas money or the time. My only concern is that the police will not do much based on not having any evidence that this person did this.  Someone would have to testify that they saw it, and even then it's just their word.  I am not a cop, but I did study criminal justice.

The kid's next door told the Uncle of the owner's who check on the house that it was the other agent...the owner's are angry to say the least...I will discuss this with them first. They probably need to file a report as well as they do not live in the same state any longer.  The brother-in-law watches the property, however he lives about 15 minutes away... I live 30 miles...A nice AR referral...a little hard to drive by every day from my home...at least with these gas prices...

Karen - This is outrageous!  I would think that you could file a police report as this is destruction of your property (the sign).  The other agent is also trespassing on private property.  It is also vandalism and makes the neighborhood look and feel unsafe.  Once the police report is filed, you should contact your state's real estate commission and see what the next steps are.  A certified letter from you with a "CC:" at the bottom showing that you are sending a copy to your attorney might do the trick, stating that you want this to cease immediately or you'll take further action.  If the broker is also a REALTOR, report this situation to the local and state REALTOR associations as it reflects very poorly on our profession.  Let me know how this turns out.

Hi Karen!  I would definitely set up a video cam inside the sellers home if possible.  If they have a PC, you COULD even set up a webcam focused on the sign which you could monitor from your office, or have the video recorded to a portable external hard drive, then you would have the evidence.   I'm sure it is a misdemeanor crime, but I bet the Real Estate Commission in your area would like to see THAT video!  --Greg

You can contact the police but you cannot accuse anyone unless you've seen them do it, so, I would hire a tech guy to install a camera on the exterior of the house pointed on the sign area and I'd have a blast catching the one that is doing it red-handed.

Exactly, but at the cost....The neighbor's are the one's who ID'd the guy...so...the police can get the info...would you pay to put in a camera? On a $400K deal...or would you leave it to the police?

Karen, It really doesn't cost that much for the cam set up. You could do it several ways mentioned above in prior posts. It would be so awesome to actually have footage of this person in action wouldn't it??? Its really a matter of principle, not money, I would think. Yea, put it on U-Tube!!!!! You go girl, catch 'em.
