Disclosed Dual agency.

We are allowed to have dual agency relationship in Pa. if it is disclsed to both parties.

I had such an experience recently. The last time I had a similar situation, I suggested another agent help the buyer . This time the buyer requested me to help out and the seller did not mind either. I suggested that both parties talk to their own attorney. At first neither was interested but then the seller spoke to an attorney and at this time I felt it was better that the buyer also get legal advice.

I am glad they both had their own attorneys because at first there were some issues that came up and then it was all resolved and we had a smooth settlement.

Both the Buyer and Seller are pleased and both have  sent me Thank you Cards.

I'm glad it all worked out.  We can have disclosed dual agency as well here in WI, but either the realtor has to remain neutral in negotiations (dual agency) or two realtors from our office have to be involved to each give pricing and negotiation advice to buyer and seller seperately.  Buyer's agency is not huge in our area, so it rarely comes up around here.

Gita -- I am glad all worked out.  However, as you propbably experienced, dual agency, though legal when disclosed, is fraught with possible liability.  You did the right thing having both parties seek legal advice!  I think the better practice is to refer one party out to another firm -- but that is usually frowned upon.

Hi Gita,
We have dual agency in NC too and all I have handled turned out well.  It is a difficult situation at best and I believe the way you handled it was very wise.
