I got a call from a realtor the other day saying they saw my listing the other day in the Bham News but it was titled as though it was a FSBO. When they called the number, it was another agent, not me. The agent went on to say that it was a lease purchase (in which it is). Is this a ploy to get buyers and can she legally do that with my listing????

Each state is different but I can't imagine what you describe is legal. It certainly would not be in Maryland. I would call your state's licensing authority and let them handle it.

I don't know for sure but it doesn't sound legal and therefore should be made illegal if it isn't.
Comes down to the owner, perhaps the owner authorized the ad?
I have owners that want the house sold or an least rented. I do my stuff, but they run their own rental adds. Its not uncommen that I coordinate with a property manager (licensed RE agent) on stuff.
The owner can violate your agreement by authorizing another agent to advertise it. Thats between you and the owner. If nobody agreed to let the agent sell the house then likely there are violations.
I have asked many agent if I could promote their properties for sale via the web and advertising. Sure everything looks like it is my listing (name phone number, etc). End result though is the house gets sold. I saw one of my listings advertised on the web by an agent. I called him, told him I had additional pics he could use, and let me know if his clients had any other questions. My seller wants it sold, I'll help any agent that wants to promote my product?
I would say techniquely it is illegal just from what you said. I would then ask is this other agents actions harming the sale of your clients property? I would welcome any agent to take my listings and promote as their own as long as they bring me a contract acceptable to my seller.
